Hainan Daily, Haikou, June 21st (reporter Lin Ying, special reporter Liu Jia) - After being pursued for stealing diesel oil multiple times, the suspect drove over a police officer, causing his death. On June 17th, the First Intermediate People's Court of Hainan made a first-instance verdict on this case. Hu Haibo was sentenced to death for robbery and theft, with all political rights deprived for life. He was also ordered to compensate the victim's family for economic losses amounting to 324,208.72 yuan. Co-defendant Huang XinChao was sentenced to five years in prison for theft.

Multiple thefts of car diesel oil in Wenchang and other places

It was found that defendant Hu Haibo, from Rong County, Sichuan Province, rented Room 311 at Huayang Hotel in Changsha Town, Wenchang City. Defendant Huang XinChao, from Shui Cheng County, Guizhou Province, also rented Room 311 at Huayang Hotel in Changsha Town, Wenchang City. Between November 2008 and May 2009, Yu KangRong (at large, handled separately) gathered defendants Hu Haibo and Huang XinChao to steal diesel oil in Changsha Town, Wengtian Town, and Penglai Market of Wenchang City. Yu provided them with a car as a tool. Each time they went out to steal diesel oil from cars, Hu drove and waited in the car while Huang got out to pry open the fuel tank cap and insert the oil pipe. After succeeding, Yu KangRong sold the stolen diesel oil and distributed the proceeds.

Running over an investigating police officer during pursuit leading to death

At around 3 AM on May 11, 2009, defendant Hu Haibo drove a Mitsubishi SUV with Huang XinChao to Penglai Market in Wenchang City to steal diesel oil from trucks parked by the roadside. While the two were stealing diesel oil, five police officers from the Penglai Police Station of Wenchang Public Security Bureau arrived at the scene in a police car. Officer Chen Jiagun drove the police car about one meter in front of Hu Haibo’s vehicle to block their way, while Lin Tingxun and three others got out of the car to make the arrest. Upon seeing this, defendant Huang XinChao fled the scene. Defendant Hu Haibo quickly reversed about two meters and attempted to turn left to escape. Officers Lin Tingxun and Wang Lushun quickly moved forward to stop him. Lin Tingxun stood in front of the car, holding onto the bumper and tapping on the hood to signal stopping, while Wang Lushun was on the right side of the SUV, tapping on the window glass to indicate stopping. Ignoring their attempts, Hu Haibo drove forward, knocking down Lin Tingxun, turned sharply to the left, and ran over Lin Tingxun's body before fleeing towards Qionghai. On the afternoon of May 11, 2009, defendant Huang XinChao surrendered to the police officers of Wenchang City. According to the forensic examination, Lin Tingxun died due to being run over by a motor vehicle.

Sentenced to death in the first trial for committing robbery

The First Intermediate People's Court of Hainan believed that defendants Hu Haibo and Huang XinChao, with the purpose of illegal possession, conspired multiple times to commit theft. Defendant Hu Haibo conspired to steal eight times, with a total value of 15,893 yuan, while defendant Huang XinChao conspired to steal ten times, with a total value of 22,997 yuan. Both committed thefts of significant amounts. The prosecution's charges were clear, with substantial evidence, thus constituting theft crimes. During the theft of diesel oil, defendant Hu Haibo resisted arrest twice by using violence on the spot, driving over public security officer Lin Tingxun and causing his death. His actions transformed from theft to robbery, with clear criminal facts and sufficient evidence. The circumstances were particularly heinous, and the consequences extremely severe. Furthermore, after the incident, defendant Hu Haibo twice accelerated through roadblocks set up by the police officers, disregarding their safety, posing a great social danger. Therefore, he should be severely punished for robbery. Thus, the court legally made the above judgment.

Defendant Hu Haibo has appealed against the first-instance judgment, arguing that the sentence was too heavy.
