There has been a new development regarding the case of male contestant E Jiehao suing female contestant Sun Yali for breach of promise to marry from the show "If You Are The One", over the return of a BMW car previously gifted to her.
Female contestant Sun Yali refused to return BMW car after breaking off engagement and was sued
On the morning of June 16, the Chaoyang Court announced its first instance verdict that the BMW car had the nature of a dowry. Since the car was registered under Sun Yali's name and already in use, the court sentenced Sun Yali to pay back 280,000 yuan to E Jiehao, which is equivalent to 94% of the purchase price. Sun Yali's agent disagreed with this decision and will consult with Sun Yali before deciding whether to appeal.
Female contestant broke off engagement and was asked to return car price
According to plaintiff E Jiehao's lawsuit, last September, the plaintiff and defendant met during the recording of Jiangsu Satellite TV's program "If You Are The One". In October, they established boyfriend-girlfriend relationship. The plaintiff bought a BMW 318 car for defendant Sun Yali with the purpose of getting married, registering it under Sun Yali's name. During their interaction, Sun Yali found out that E Jiehao's family background was far from what he described, so she refused to get married. Thus, E Jiehao requested Sun Yali to return the BMW car worth 296,900 yuan.
In May this year, after E Jiehao filed a lawsuit to the Chaoyang Court, Sun Yali posted on Weibo that she was "framed". Her agent said that the two were not boyfriend-girlfriend, and there was no talk of marriage. When the case went to trial, Sun Yali's agent admitted for the first time that the two were once in a romantic relationship, and that the involved BMW car was purchased by E Jiehao. However, he denied that Sun Yali ever met E Jiehao's parents or that there was any marriage contract between them.
Her agent claimed that while interacting with Sun Yali, E Jiehao was also interacting with other girls. After discovering this, Sun Yali refused to continue the relationship. Defendant Sun Yali,
Defendant's agent objects to the ruling
The Chaoyang Court believed that the BMW car had the nature of a dowry, and Sun Yali should return most of the BMW car's value that had the nature of a dowry. Now since the car was already registered under Sun Yali's name, the court decided based on the car's value and usage time that Sun Yali should return 280,000 yuan to E Jiehao, which is equivalent to 94% of the purchase price. Sun Yali's agent objected to this judgment and said that they would consult with Sun Yali before deciding whether to appeal.
BMW's "nature" refers to customs and other factors
The judge from Chaoyang Court introduced that Jiangsu Satellite TV's program "If You Are The One" is itself a television show aimed at helping men and women find suitable marriage partners, and the participants generally participate with the mindset of achieving a good match.
E Jiehao and Sun Yali met during their participation in this program and quickly established a boyfriend-girlfriend relationship. Based on the case details, it can be determined that both parties expressed the intention to marry soon after establishing their romantic relationship.
Based on this, the nearly 300,000 yuan car purchased by E Jiehao should be considered as an expensive item. It is different from the general gifts given during a romantic relationship to promote feelings and express intentions. Combining traditional Chinese customs, modern social sentiments, and the value of the BMW car, this BMW car has the nature of a dowry.
