Case Recall: Tragedy Caused by Drunk Driving of a Motorcycle

Yesterday morning, the Ganjingzi District People's Court held a hearing for Luo's case involving a traffic accident that resulted in a death. Unlike other traffic accident cases, the Ganjingzi District Civil Affairs Bureau appeared in court as a plaintiff in a civil suit attached to the criminal case, requesting the court to rule that the defendant pay over 380,000 yuan in compensation for the "John Doe" who died in the car accident. It is understood that this approach of the civil affairs department acting on behalf of unidentified victims in legal actions is the first of its kind in Dalian and also relatively rare nationwide.

At around 9:00 AM, this special traffic accident case was heard at the Ganjingzi District People's Court. The indictment from the Ganjingzi District People's Procuratorate showed that at 22:05 on June 4, 2007, Luo drove a two-wheeled motorcycle without a license plate while under the influence of alcohol, carrying a male passenger along the Zhanghu Line in Ganjingzi District from east to west. Due to improper operation, Luo crashed into a concrete guardrail by the roadside at a certain section near Xiayeh River, resulting in the male passenger falling onto the road and dying at the scene, while Luo himself was injured. After examination, it was determined that the deceased had head injuries and skull fractures, dying from severe brain trauma. The traffic police department determined that Luo was fully responsible for this accident. Later, Luo was listed as an online fugitive. It wasn't until June this year that Luo was arrested by the police on a train.

After the incident, the public security organs conducted extensive investigations but were unable to determine the identity of the deceased, leaving him as a "John Doe." After the case was transferred to the Ganjingzi District Procuratorate, the decision was made to file a public prosecution against Luo. The procuratorate also coordinated with the Ganjingzi District Civil Affairs Bureau, allowing them to appear in court and file a civil lawsuit on behalf of the "John Doe."
