The court ruled that the car belongs to the couple's joint property, and the husband's gift was invalid, and should be returned immediately.
38-year-old Hu is the owner of a private enterprise. Two years ago, after meeting Fan, the marketing supervisor of a grand hotel, they developed an extramarital affair. In order to flatter the other party, on Christmas Day in 2010, Hu bought a 150,000-yuan car for Fan without his wife Zheng knowing, and registered it under Fan's name. Just after this year's Spring Festival, the relationship between Hu and Fan was exposed. After a big argument, Hu told his wife about the car gift. Enraged, Zheng sued Hu and Fan.
The court held that Hu had disposed of the couple's joint property without Zheng's consent, and purchased a car for Fan. The amount involved is large, and his behavior of giving the car for free has damaged Zheng's legal rights, therefore it is invalid. Eventually, the court ruled that Hu's act of giving Fan the car was invalid, and Fan should return the car to Zheng and Hu.
