Using their positions for personal gain and suspected of accepting bribes, they illegally arranged for a criminal to be granted temporary release from prison on medical grounds. Recently, the case of Du Mou, former vice president of Chaoyang County Court in Chaoyang City, for accepting bribes was brought to trial at Jianping County Court. Also on trial with him was Zhao Mou, former deputy presiding judge of the Criminal Division of that court.
The prosecution claimed that the People's Procuratorate of Chaoyang County prosecuted Ji Mou on charges of rape, robbery, and extortion and brought the case to the People's Court of Chaoyang County, which was presided over by Zhao Mou, the deputy presiding judge of the Criminal Division. Ji Mou’s father, in order to keep his son from being detained, approached Bao Mou, the director of the Civil Division Four of that court, to inquire if Ji Mou could possibly be sentenced to probation or granted medical parole. Zhao Mou stated that there was no possibility of probation but that medical parole would require the approval of Vice President Du Mou.
Thus, Bao Mou approached Du Mou and received 190,000 yuan in bribes from the Ji family on three occasions, giving 70,000 yuan to Du Mou and 30,000 yuan to Zhao Mou. Subsequently, through the efforts of Du Mou and Zhao Mou, Ji Mou was taken out of the detention center to undergo a physical examination at the hospital.
Following this, with Ji Mou’s fake medical diagnosis report, Du Mou signed off on the "Decision on Release on Bail" and "Criminal Judgment" drafted by Zhao Mou, releasing Ji Mou on bail due to illness on the same day. He also delivered the criminal judgment sentencing Ji Mou to seven years in prison and a fine of one thousand yuan. On February 12, 2009, the court issued to convicted criminal Ji Mou the "Decision on Temporary Execution Outside Prison," drafted by Zhao Mou and signed by Du Mou, allowing Ji Mou to be temporarily executed outside of prison. Later, Du Mou returned the 70,000 yuan cash to Bao Mou, who then returned a total of 120,000 yuan to the Ji family.
The prosecution accused Du Mou and Zhao Mou of using their official positions to accept bribes and has prosecuted them in court, demanding that they be punished accordingly.
Du Mou and Zhao Mou's defense lawyers argued for their innocence during the trial, which lasted from 10:00 AM to around 7:00 PM on December 7th this year. The verdict was not announced in court.
