Gao and his wife, Xu, operated a communications store in the new village of Xiaobanqiao Town. Since late October last year, Gao, who was suffering from an illness, discussed with his wife the idea of adding a "ticket selling" service to increase the store's revenue. As a result, the business boomed, but they now face the threat of imprisonment.
Kunming Railway Transport Procuratorate charged that between late October 2010 and January this year, Gao and his wife illegally profited by pretending to sell train tickets, buying tickets and reselling them for an additional 5 to 30 yuan per ticket. On January 11, Gao and his wife were caught on the spot by the police. Investigations revealed that the couple had scalped a total of 403 tickets, with a face value of RMB 120,480. In court, Gao and his wife admitted guilt regarding the charges from the prosecution.
"The amount of money involved in scalping tickets exceeding 5,000 yuan, or illegal profit exceeding 2,000 yuan is considered serious, and should be pursued as a criminal offense." The prosecutor believed that the amount of money involved in Gao and his wife's ticket scalping reached 120,000 yuan, which is more than 24 times the standard for filing a case, making it a serious situation. However, considering their good attitude in admitting guilt, and the fact that Gao has been sick for a long time, leading to financial difficulties, their subjective malice is not great. Furthermore, Xu only helped sell tickets when her husband was out, making her an accomplice. Therefore, the prosecutor suggested the court consider leniency, sentencing Gao to 1 year and 6 months to 2 years in prison. Xu would receive a sentence of 1 to 1 year and 6 months in prison, with probation applicable.
Boyfriend under criminal detention, girlfriend helps sell tickets
On January 23 this year, a woman named Wan was found by the police with 88 train tickets worth 15,596 yuan on her person, and could not explain their source.
After repeated questioning by the police, Wan confessed that the tickets all belonged to her boyfriend Xiao, who had already been administratively detained for scalping tickets. She was helping sell the tickets to make up for the losses.
After the incident occurred, Xiao was criminally detained by the police. After investigation, the Kunming Railway Procuratorate prosecuted Xiao in court. It was determined that in January 2011, Xiao multiple times went to various ticket outlets in Kunming city such as Tielv outlet and Dongjiao Road Jujiacun outlet to purchase tickets, stockpiling 88 tickets for trains from Kunming to Guangtong, Xuanwei, Chengdu, Chongqing, and from Guangtong to Chengdu, intending to resell them at higher prices. These tickets had a face value of 15,596 yuan. The prosecution believed that Xiao's actions涉嫌 scalping tickets crime, and he should be sentenced to 6 months to 1 year in prison.

At 11:40 AM on January 26, 2011, plainclothes officers, during routine patrols, happened upon a man arranging to buy high-priced train tickets over the phone. Thus, the officers followed this man to Dashanghui, where they apprehended Li, suspected of scalping tickets. From Li's person, the officers searched and found 36 train tickets of various routes including Kunming to Beijing West, Shijiazhuang, Nanjing, Hangzhou South, Lijiang East, etc., with a face value of 8,188 yuan.
This case was tried in court yesterday, with the prosecution charging Li with the crime of scalping tickets, and recommending a sentence of more than 6 months to less than 1 year in prison.
