Morning Post News (Reporter Xin Wu): Yuan, a man from Jiangsu province, was caught by the police while driving a small car under the influence of alcohol on the auxiliary road of the Jinghu Expressway. However, Yuan refused to cooperate with the police investigation and instead locked the car door, sleeping in the car. Yesterday, defendant Yuan was tried at Xiangyang Court. The court sentenced Yuan to two months of detention.
In the final phase, Yuan did not defend himself much. "I know I was wrong; I shouldn't have driven after drinking," Yuan said. He admitted his guilt and hoped other drivers would take him as a warning not to drive under the influence of alcohol. The court believed that defendant Yuan had weak legal awareness, driving under the influence of alcohol, which constituted dangerous driving. Xiangyang Court sentenced Yuan to two months of detention and fined him 1000 yuan.

However, when the officer caught Yuan, he did not cooperate with the police investigation. The officer asked Yuan to get out of the car for testing, but Yuan did not leave the car. Instead, he rolled up the window, turned off the engine, and locked the car door. Later, he simply fell asleep in the driver's seat.
"I was scared stiff and fell asleep in the driver's seat," Yuan said. He claimed that the car door locked automatically because he didn't get out of the car. The judge asked: "When did you get out of the car for testing?" Yuan thought for a moment and replied: "I don't remember clearly." "How long did you sleep?" "About an hour."
Yuan's colleague testified that on that evening, he and Yuan ate together at a restaurant near their workplace. Yuan drank alcohol and drove him back to their temporary residence. "I advised Yuan not to drive after drinking, but Yuan said it was fine," recalled Yuan's colleague. On the way, Yuan encountered the police. Yuan lowered the window, spoke to the officer, then rolled up the window and locked the car door. In the car, his colleague asked Yuan what to do, but Yuan didn't respond. Soon after, Yuan fell asleep. Later, Yuan's colleague noticed an ambulance parked next to the car and persuaded Yuan, "Don't make this a big deal." The colleague then opened the car door. The police determined that Yuan was driving under the influence of alcohol.
During the trial, defendant Yuan admitted his guilt. He recalled that on the night of the incident, he had dinner with a colleague and drank less than three taels of baijiu (Chinese liquor). The judge asked: "Were you drunk at the time?" "I wasn't drunk at the time," Yuan replied.
According to the prosecution, late on May 2, 2011, defendant Yuan was driving a BYD brand small car and was caught by the police when traveling on the outbound direction of the Jinghu Expressway at Dayangfang Toll Station in Xiangyang District, Beijing. After testing, it was found that Yuan's blood alcohol content was 101.6mg/100ml.
