In June 2010, Zhang Qiang spent 10 yuan to buy illegal lottery tickets for luck and unexpectedly won 1000 yuan. This 1000 yuan made Zhang Qiang dream of getting rich, fantasizing about becoming wealthy overnight, which led him to start purchasing illegal lottery tickets in a frenzy. However, after that, Zhang Qiang never had such "good luck" again, always losing more than he won, and quickly depleted his savings accumulated over several years of work. Obsessed with the illegal lottery, Zhang Qiang could not extricate himself and turned his attention to the sales proceeds of the "three products" (explosives, electric detonators, and detonation tubes) that he handled.
By the end of June 2011, Lingbao Gold Investment Company was preparing to take inventory of the "three products," verifying reports against actual stock, and notified Zhang Qiang to submit the May and June proceeds from the "three products." Fearing exposure, on June 30, 2011, Zhang Qiang fled with 1000 grams of gold (five gold bars, each weighing 200 grams, valued at 322,500 yuan) purchased using the sales proceeds of the "three products," along with 30,000 yuan in cash. He was later apprehended, with 14,000 yuan in cash and 1000 grams of gold seized on the spot. After his arrest, Zhang Qiang truthfully confessed to his crimes and exposed the criminal activities of Xu Mou, who sold illegal lottery tickets.
From August 2010 to June 2011, Zhang Qiang used his position overseeing the clearing of accounts between the procurement department and the company's finance department. When creating the "three products" in/out inventory reports, he reduced the out-of-stock numbers and increased the inventory numbers, failing to remit part of the proceeds from the "three products." Each month, he embezzled anywhere from 300,000 to over 2 million yuan, all of which he used to buy illegal lottery tickets. At the height of his obsession, Zhang Qiang once spent over 1 million yuan on a single purchase. Each time he misappropriated funds, Zhang Qiang thought he would definitely win this time, recover his costs, repay the money, and then stop buying lottery tickets, but every time he lost everything. By the time the case was uncovered, Zhang Qiang had misappropriated a total of 11,030,000 yuan.
Due to accidentally winning a 1000 yuan prize from a 10-yuan illegal lottery ticket, the 27-year-old Zhang Qiang became obsessed with illegal lotteries and could not break free. Using his position as an accounting officer in the procurement department of Lingbao Gold Investment Company, he embezzled 11,030,000 yuan in sales proceeds within less than a year. On January 30, the Intermediate People's Court of Sanmenxia City concluded this case triggered by the purchase of illegal lottery tickets. The defendant Zhang Qiang was found guilty of embezzlement and sentenced to life imprisonment, with confiscation of personal property worth 50,000 yuan.
The court determined that although Zhang Qiang provided information leading to the investigation of others' criminal activities after his arrest, constituting meritorious service, his actions caused significant losses to the state, and the crime's consequences were exceptionally severe, making it insufficient grounds for leniency. His act of corruption, however, saw most of the stolen funds recovered, warranting a lighter punishment. Therefore, the court sentenced Zhang Qiang to life imprisonment for embezzlement, depriving him of political rights for life; to 10 years and six months in prison for corruption, with confiscation of personal property worth 50,000 yuan; and combined sentences resulted in life imprisonment, with confiscation of personal property worth 50,000 yuan.
