Previously, the media reported that Ms. Ma claimed to have been raped twice in the treatment room by her attending doctor Yang on July 18 and August 22, 2011 while she was being treated for hemorrhoids at Kunming First People's Hospital. Ms. Ma filed a report in August and approached the hospital multiple times hoping the administration would investigate and provide compensation. The hospital’s response was that this matter involved criminal offenses and they hoped Ms. Ma would resolve it through legal channels. In the non-prosecution decision document issued by Xishan District Procuratorate on February 7, the investigation result from Kunming Public Security Bureau Xishan Branch showed that both parties admitted to having had sexual relations twice. However, Ms. Ma claimed that this happened under violent means by Doctor Yang, which Yang denied. Therefore, the procuratorate believed that the facts of the crime were unclear and the evidence insufficient, not meeting the conditions for prosecution. Regarding this outcome, Ms. Ma said she could not accept it. Ms. Ma stated: "It is unreasonable to ask me to sign and say I won't sue, how can that be possible? What they call insufficient evidence are all there, such as the bite mark on him, that counts as evidence, and other mentioned pieces of evidence." Ms. Ma said that next Monday she will file an appeal with Kunming City Procuratorate.
At Xishan People's Hospital, reporters met Ms. Ma who came for a dressing change. Ms. Ma specifically requested that no male doctors help her with the dressing change. On February 9, the day Ms. Ma was informed to go to Xishan District Procuratorate to pick up the non-prosecution decision document, she refused to sign the decision and slashed her wrist on the spot, requiring eight stitches. Ms. Ma told reporters that due to the intense emotions and sadness that day, after waiting so long, she thought that the court should immediately be notified. Unexpectedly, the result was non-prosecution, leaving her too heartbroken, so she cut her veins with a small eyebrow razor blade she carried with her, determined to see the law punish him even if it meant dying.
Last November, a female patient claimed she was raped by a doctor at Kunming First People's Hospital during treatment. On February 9 this year, this female patient received the non-prosecution decision document from Xishan District Procuratorate and attempted self-harm out of anger.
