Yunnan Daily reports that a man from Fangcheng County in Nanyang went to work at a coal briquette factory in Shandong and was "imprisoned" by the "evil-hearted" boss who made him work for 6 years without paying him a cent. Later, when the man fell seriously ill, the boss lied about taking him to the hospital but instead abandoned him in the wilderness outside Handan City in Hebei Province. After "Coal Briquette Brother" was sent back to his hometown in Fangcheng, his condition worsened and he urgently needed money for treatment. The Legal Aid Center of the Fangcheng County Justice Bureau rushed to Shandong to fight for his rights, but the "evil-hearted" boss refused to help. It wasn't until several days after "Coal Briquette Brother" died with resentment that the "evil-hearted" boss finally paid over 270,000 yuan in wages and compensation, using an ultraviolet spectrophotometer.
The man worked under "soft detention" and did not receive a penny for 6 years.
Yesterday, the brother of "Coal Briquette Brother," who had just received over 270,000 yuan in wages and compensation, complained to the reporter.
"Coal Briquette Brother" was named Ma Jinyu, from Wang Jiaying Village in Gaihe Town, Fangcheng County. Ma Jinyu's brother said that before his death, his younger brother told him that after the Spring Festival in 2005, he went to Jinan to work with villagers from his village. However, upon arriving in Jinan and getting off the train, he got separated from his fellow villagers. With no money, he had to wander around on the streets. A week later, Ma Jinyu left the city and arrived at a coal briquette factory where Mr. Sun, the boss, saw him and invited him inside. After learning about Ma Jinyu's situation, Mr. Sun let him stay and work at the coal briquette factory, promising to pay him 400 yuan per month with full room and board.
Ma Jinyu was very happy at the time. However, after one month, when he asked Mr. Sun for his wages, the boss told him, "You are here alone; if I give you the money, what if you lose it? Let me settle it with you at the end of the year." By the end of the year, however, Mr. Sun refused to pay Ma Jinyu's wages, citing poor business. Mr. Sun also bought four large wolves dogs to strictly supervise the workers, not allowing them to take even a step outside. Ma Jinyu was thus "soft detained" in the coal briquette factory for 6 years, receiving no wages at all.
After falling ill and being abandoned, he was discarded far away in Handan.
Starting in 2009, Ma Jinyu began feeling unwell, but Mr. Sun still would not let him leave. Once, when Ma Jinyu was too sick to get out of bed, the foreman responsible for supervising the work accused him of faking illness to avoid work and beat him severely, forcing him to continue working. It wasn't until after the Spring Festival in 2011 that Ma Jinyu's condition suddenly worsened and he could no longer get out of bed. Only then did Mr. Sun take him to the hospital, where he was diagnosed with tuberculosis of the spine accompanied by paraplegia.
One day after the Spring Festival, Mr. Sun suddenly proposed to send Ma Jinyu to a big hospital for treatment. Believing him, Ma Jinyu was thrilled and got on the white minivan rented by the boss early that morning. After driving for more than ten hours, the people on the car lifted him out and gave him nine sausages, telling him to wait there before turning around and leaving.
A kind-hearted local person found Ma Jinyu and called 110 to report the incident. Ma Jinyu then realized he had been abandoned thousands of miles away in Handan City, Hebei Province. The Handan police contacted the Fangcheng police, who then located Ma Jinyu's family. At this point, Ma Jinyu's parents had already passed away due to illness, so other relatives from Ma Jinyu's family rushed to Handan and brought him back to the local hospital for treatment.
Lawyers represented him in fighting for his rights, but the "evil-hearted" boss refused to pay.
On March 23, after learning about Ma Jinyu's plight, Director Li Guishan of the Fangcheng County Justice Bureau immediately assigned lawyers Du Hongshan, Zhang Wei, and Wang Wei from the Legal Aid Center to provide legal assistance.
On March 25, the Fangcheng County Justice Bureau dispatched four staff members to Jinan. After five days of investigation, they finally found the coal briquette factory where Ma Jinyu worked in Dajiao Town, Tianqiao District, Jinan City. They met with the boss, Sun Xiurong, and confirmed the case before reporting to the Tianqiao Branch of the Jinan Public Security Bureau, accusing Sun Xiurong of涉嫌 "forcing employees to labor."
On the afternoon of March 31, Officers Liu and Sun from the Dajiao Police Station found the boss, Sun Xiurong, at the coal briquette factory. According to Sun Xiurong, Ma Jinyu's reported issues were basically true: Ma Jinyu indeed worked at the coal briquette factory for six years, and Sun Xiurong indeed did not pay him any wages.
On April 1, Officers Liu and Sun from the Dajiao Police Station traveled to Fangcheng County People's Hospital in Nanyang City to investigate and gather evidence from Ma Jinyu. Ma Jinyu and his family demanded that the Shandong police hold Sun Xiurong legally accountable while also demanding immediate repayment of Ma Jinyu's wages so he could seek medical treatment.
Dying with resentment, the boss signed an agreement agreeing to pay.
According to the victim Ma Jinyu's brother, after the Shandong police left, Ma Jinyu and his family waited anxiously every day and night, but until April 22 when Ma Jinyu passed away, they had not yet received the wages and compensation he deserved.
Lawyer Du Hongshan from the Fangcheng County Legal Aid Center once again sent letters to various units in Jinan, including the Political and Legal Affairs Commission, the Public Security Bureau, and the Labor Bureau, requesting resolution of Ma Jinyu's issue. According to Du Hongshan, after receiving the letter, the Political and Legal Affairs Commission of Jinan immediately convened a liaison meeting and closed down the coal briquette factory where Ma Jinyu worked, asking the aid lawyer to go to Jinan to coordinate Ma Jinyu's compensation matters.
Upon receiving the information, Du Hongshan once again rushed to Shandong. After negotiation, Sun Xiurong finally signed an agreement with Ma Jinyu's relatives. According to the agreement, Sun Xiurong compensated 260,000 yuan in wages and losses, plus 13,500 yuan in medical expenses, totaling 273,500 yuan. However, the condition was that Ma Jinyu's relatives "agree to withdraw the lawsuit and no longer pursue the responsibility of the coal briquette factory boss."
