According to reports, Xin and Gao decided to rob someone for money to pay for their return home after they were deceived by an employment agency when they came to Beijing looking for jobs. When 27-year-old Ms Li was walking alone, the two rushed towards her with knives, and stabbed her to death when she resisted. It was learned this morning that the No. 2 Intermediate People's Court sentenced Xin and Gao to death in the first trial for robbery, and ordered them to compensate Ms Li's parents for losses exceeding RMB 600,000 yuan. According to Xin, he was deceived by an employment agency when he came to Beijing looking for a job. On the night of the incident, he went to an ATM machine of a bank near ZhaoGongKou to withdraw money to go home, but there was less than RMB 100 yuan in his account, so he failed to withdraw any money. By this time, the bank had already closed. At a loss what to do, Gao who was sitting on the steps of the bank started chatting with him. They found that they had similar experiences: both of them had been deceived when looking for jobs, and almost had no money left. "How can we go home without money? Let's rob someone!" Xin suggested robbing, and Gao agreed with a nod. They planned to rob someone nearby. At the same time, Ms Li who had just arranged for a friend to stay at a hotel near ZhaoGongKou was walking home, and became the target of Xin and Gao's robbery. According to Xin's confession, they chose Ms Li because her backpack was very conspicuous. They thought she looked rich and probably had money. There were other single women who had passed by earlier, but as they did not think these women had money judging from their clothing, they did not make a move. The victim Ms Li worked as a manager in a department of the ZhuangSheng ChongGuang Department Store. The day before the incident, she called home and said that she had decided to resign and go back to work in her hometown in Henan Province. During the trial, Ms Li's parents requested that the two defendants be severely punished. Ms Li's parents required the two defendants to compensate them for various losses including death compensation and funeral expenses exceeding RMB 600,000 yuan. Even if they were deceived, it cannot be used as a reason for leniency. Xin, 22 years old, is a farmer from a village in ChiFeng City, Inner Mongolia Autonomous Region. Gao, who is only 20 years old, is a farmer from HeJian City, Hebei Province. Investigations by the court revealed that Xin and Gao plotted to rob, and around 11 p.m. on August 3, 2010, intercepted the 27-year-old victim Ms Li near the HanTing Chain Hotel on the east side of the ZhaoGongKou Long-Distance Bus Station in FengTai District. Xin threatened Ms Li with a dagger, while Gao took the opportunity to snatch her backpack. After Ms Li resisted, Xin stabbed her several times in the chest, back, and left upper limb with the dagger, causing her death due to rupture of the heart and liver. After snatching Ms Li's backpack, Xin and Gao fled the scene. There was RMB 3200 in cash and a Nokia mobile phone worth RMB 1120 inside the bag. 26 hours after the case happened, Xin and Gao were captured in LangFang City, Hebei Province by the FengTai Public Security Bureau. Xin's defense lawyer argued that Xin normally behaved well, and it was only after being deceived by an employment agency in Beijing when looking for a job that he decided to commit a crime, and thus, he is a first-time and occasional offender. Gao's defense lawyer claimed that he was deceived which indirectly led to the occurrence of this case, and thus, he has little subjective malice, shows remorse, and is a first-time and occasional offender, and therefore, should be given a lighter sentence. The court held that there is no evidence proving whether the two defendants were deceived before committing the robbery, and even if they were deceived, it cannot be used as a reason for committing a robbery, or as a reason for a lighter punishment. Based on this, the court made the above-mentioned ruling.
