In recent days, a colleague's "drunken driving" behavior has given Luo Haojie, the Deputy Director of the Danling County Public Security Bureau and the Director of the Traffic Police Team in Sichuan Province, a major headache.
On the evening of May 3rd, the traffic police team of the Danling County Public Security Bureau was conducting law enforcement inspections at the Jiulong Square in the county. At that time, "drunken driving" was at the forefront of public attention, and was a violation strictly investigated by traffic police all over the country. Starting from May 1st, the punishment for illegal drunk driving behavior in our country has been elevated from administrative penalties to stricter criminal penalties.
That night, Su Renxun, the deputy director of the Danling County Water Conservancy Bureau, ran into trouble. Around 7:00 PM, the traffic police conducted an inspection on a black Santana car with the license plate number Sichuan Z50504, and the on-site breath alcohol test showed that the driver's alcohol concentration reached 88mg/100ml, exceeding the "drunken driving" standard of 80mg/100ml. The inspected driver was Su Renxun.
The duty traffic police then took this deputy director to the Danling County People's Hospital to extract blood samples, and legally summoned him to the county traffic police team for questioning and investigation.
Originally, after leading a full-day inspection of the county's rural drinking water work, Su Renxun had dinner with several staff members at a restaurant in the city. During the meal, Su Renxun drank one liang (about 50 grams) of baijiu and two bottles of beer.
Despite the fact that the newly criminalized "drunken driving" was the focus of public attention, this official clearly did not take the "criminalization of drunken driving" seriously. After dinner, he drove the black Santana to send his colleagues home. Unexpectedly, shortly after leaving the restaurant, he was stopped by the traffic police.
According to the national mandatory standard "Threshold Value and Test for Blood and Breath Alcohol Content of Vehicle Drivers", the standard for defining drunken driving is a blood alcohol content greater than or equal to 80mg/100m1. Since there were no qualified testing institutions in Danling County, after extracting Su Renxun's blood sample, the police sent the sample to Chengdu for testing.
The test results were not available until May 16th. The results showed that Su Renxun's blood alcohol content was 95mg/100m1, reaching the "drunken driving" standard.
However, the Danling police did not impose penalties on Su Renxun according to the "criminalization of drunken driving" standard, but instead fined him 1900 yuan and temporarily confiscated his driver's license for six months as an "administrative penalty" - this is the penalty standard for ordinary drunk driving.
When interviewed by China Youth Daily, Luo Junjie explained that Su Renxun's case matched Article 13 of the Criminal Law, so "administrative penalties" were adopted at that time. According to Article 13 of the Criminal Law, for behaviors with obviously minor circumstances and little harm, they may not be considered crimes.
Luo Junjie also said that after the blood sample test results came out, due to insufficient understanding of the law, and considering Su Renxun's good attitude towards confession, we rashly believed that Su Renxun's behavior was relatively minor, which was in line with the statement of Zhang Jun, Vice President of the Supreme People's Court, that "drunken driving is not necessarily always subject to criminal penalties," so we punished Su Renxun according to the standard of "ordinary drunk driving."
Luo Junjie also denied the claim of "favoritism cases." "How could the police possibly handle 'favoritism cases'?" He said that at the law enforcement scene on May 3rd, there were not only police officers from the Danling County Traffic Police Team, but also supervising police officers from the superior Meishan City Traffic Police Brigade.
On May 24th, Huaxi Metropolis Daily reported on Su Renxun's case. The subheading of the report said: Relevant persons from the Meishan City Danling County Traffic Police Team stated that because the deputy director and others had minor circumstances, whether they would be "subject to criminal penalties" would have to wait for the issuance of judicial interpretations by the Supreme People's Court.
Subsequently, the punishment for Su Renxun underwent significant changes. On May 24th, the Danling County police revoked the previous "administrative penalty" decision, believing that Su Renxun's behavior was suspected of constituting "dangerous driving crime." The next day, the police transferred the case to the Danling County People's Procuratorate. A situation bulletin provided by the Danling County Public Security Bureau Traffic Police Team showed that Su Renxun had already been released on bail.
"Looking at it now, indeed, he should have been punished according to 'drunken driving.' There were deviations in our grasp and understanding before," Luo Junjie said.
Su Renxun's drunken driving case drew attention from the Sichuan Provincial Public Security Department Traffic Police Corps. On May 25th, the Sichuan Provincial Public Security Department Traffic Police Corps held a special training session on "criminalization of drunken driving" in Meishan City, where Danling County is located. On the evening of the 26th, I still saw banners hung by the traffic police department on the main road entering Meishan City to welcome leaders participating in the "criminalization of drunken driving" training session.
