Reporter: In our country, generally speaking, there are always urgent factors that need to be standardized within related industries and fields. Specifically, these are long-term difficulties and barriers that have plagued the development of our country’s industry associations which urgently need to be broken down. In fact, currently in our country, there is no specialized unified legislation for industry associations. The existing specific legislation about industry associations is also relatively scattered and disorganized, mainly reflected in regulations, some rules and systems, as well as laws regarding the management of industry associations issued by some provinces and cities. These mainly include the 1997 "Pilot Scheme for Selecting Several Cities to Conduct Industry Association Pilots" issued by the State Economic and Trade Commission, the 1999 "Trial Measures for Several Opinions on Accelerating the Cultivation and Development of Industry Associations in the Industrial and Commercial Fields", the "Notice on Strengthening the Standardized Management and Cultivation and Development Work of Industry Associations", and the latest 2004 SASAC "Interim Measures for the Work of Industry Associations".

All of the above are relevant rules and regulations issued by various ministries and departments, but there is no national law. This has caused our country’s industry associations to generally lack a legal status, have unclear functions, ambiguous personnel organizational relationships, insufficient funding sources, and lack of government support among many other issues. Therefore, considering this situation, relevant state departments are considering legislation. Currently, this law is widely soliciting opinions from the State Council, experts, and national associations, and is in the process of being drafted and outlined. We believe it will soon enter the legislative procedure.

Host: Although this law is still in the drafting stage, the specific provisions and content are not yet known. What is the general direction of the law? In what direction will the future industry associations develop? Do you have any knowledge in this regard?

Reporter: Experts involved in the drafting of the draft say that although the specific articles of this law cannot yet be clearly presented to everyone, the overall direction is roughly determined and should be a complete direction towards civilianization and marketization. First, further clarify the legislative subject to determine the legal status, that is, give these industry associations a clear positioning and clarify their functions. Work and projects outside the scope of functions of industry associations must be resolutely excluded to reduce the burden on industry associations.

Secondly, ensure independence in personnel matters. Because when our country's industry associations initially developed, they all had intricate ties with relevant supervisory departments, even being subordinate departments at the time. Therefore, restrictions on leaders were relatively prominent. Such personnel-related issues may be standardized through legislation to further promote marketization.

Finally, further improve the operational mechanism of industry associations. Specifically, the sources, management, and distribution of funds should be made scientific and institutionalized. Only by letting industry associations go to the market and exchange services and information for funds can they free themselves from a position of being constrained by others.
