That night, the man raped the girl. The next morning, the man discovered that the girl had unfortunately passed away. According to the forensic pathologist, the girl had died from asphyxiation due to vomit blocking her airway. The man received his legal punishment. However, the hotel where the girl stayed was also brought to court. After deliberation, the Shangyu People's Court ruled that the hotel must pay more than 50,000 yuan in economic compensation. Why was this compensation necessary? The girl, surnamed Li, was from Anhui and came to Shangyu in 2007 to work at a foot massage parlor. Around 11 p.m. on November 12, 2009, after finishing work, Li went out for late-night snacks with her colleagues. She drank quite a bit of white liquor and became so drunk that she lost consciousness. A few colleagues took her to a hotel. When they helped her to the hotel, Li suddenly collapsed due to intoxication and fell on the steps at the hotel entrance, hitting her head on the ground. At the time, no one paid much attention. One of the male colleagues, Mr. Dai, used his ID card to check into a room and proposed to stay behind to take care of Li. That night, Dai raped Li. Around 6 a.m. the next morning, Dai woke up and found Li lying beside him, her limbs cold and without a heartbeat. He quickly called the hotel to report the incident. After an autopsy, the forensic pathologist determined that Li had died from asphyxiation due to vomit blocking her airway. The pathologist believed that Li's own alcohol poisoning caused vomiting. In a state of unconsciousness and respiratory center inhibition due to poisoning, Li was unable to promptly expel the vomit, which mistakenly entered her airway, leading to asphyxiation. Although Li's head injury was not fatal, it could have induced vomiting, which was the first auxiliary cause of her asphyxiation. Dai's rape of Li while she was drunk was the second auxiliary cause of her asphyxiation. Last year, Dai was sentenced to five years in prison. Whether the hotel was responsible or not became a point of contention between the plaintiff and defendant. After Li's unexpected death, her mother believed that the hotel did not fulfill its reasonable safety obligations, leading to her daughter's harm, and thus the hotel should bear responsibility. The Li family repeatedly demanded compensation from the hotel, but the hotel refused on various pretexts. Helpless, Li's mother sued the hotel in the Shangyu court, demanding 50% of 570,333 yuan in compensation for funeral expenses, death compensation, support fees, and mental anguish, totaling 285,166.5 yuan. The Li family believed that since the hotel knew Li was already drunk and failed to provide protection, it should bear the responsibility for compensation. The hotel, however, argued that when Li was drunk and brought to the hotel by her colleagues, it was Dai and his colleagues who escorted her to the room. Neither the direct cause of Li's death nor Dai's act of rape constituted any fault on the part of the defendant in this case, and the hotel was safe. The hotel also presented a "Dual Points Management Method for the Hotel Industry" in Shangyu, proving that the hotel had no duty of supervision. Additionally, the hotel claimed that they had legally registered both Dai and the girl, and thus bore no responsibility. The court: the hotel failed to fulfill its reasonable security obligations. After deliberation, the Shangyu People's Court ruled in the first trial that the hotel bore partial responsibility for the girl's death. The court believed that this case was a dispute over a lodging service contract. When the deceased, Li, checked into the hotel, a lodging service contract was formed between the hotel and Li, obligating the hotel to provide security during Li's stay. Yesterday, the presiding judge explained that there were several inappropriate actions by the hotel in this case: When Li was brought to the hotel by Dai and others while heavily intoxicated, she was unconscious. A severely drunk female guest being supported by several men should have raised enough alarm for the hotel staff. However, they only registered Dai's ID and opened a room without making any feasible inquiries or checks. Secondly, upon seeing Li fall and hit her head, the hotel staff did not check on Li's condition. Additionally, according to relevant regulations, individuals without valid identification are not allowed to lodge, and registration by one person does not permit multiple occupants. In this case, the hotel violated these regulations and was at fault. "The defendant hotel did not fulfill its reasonable security obligations within the scope of its responsibilities, bearing partial responsibility for Li's death, and should bear 10% of the compensation, totaling 50,996 yuan," said the presiding judge.
