ATM Swallowing Card Leads to Vandalism Retaliation: A Man Sentenced to 4 Months and 5 Days for Damaging an ATM

According to the Evening News of Yangcheng (Weibo), reported by journalist Zheng Wusen and correspondent Haifaxuan, a man resorted to physically attacking an ATM after his card was swallowed during a transaction. Recently, this impulsive individual was sentenced by the Haizhu District People's Court of Guangzhou for intentional property damage, receiving a punishment of 4 months and 5 days of detention.

The Haizhu District People's Procuratorate of Guangzhou accused defendant Li Mouli of damaging the ATM on March 1, 2011, at around 9 p.m., when he used his Agricultural Bank of China card at an Industrial and Commercial Bank of China (ICBC) ATM located on Yile Road in Haizhu District, Guangzhou. After mistakenly operating the machine and having his card swallowed, Li proceeded to kick and punch the ATM, causing damage to its components (valued at RMB 5,909). It was noted that during the trial process, under the urging of the prosecution, the victimized entity, ICBC Guangzhou Yile Branch, entrusted the Haizhu District People's Procuratorate of Guangzhou to file a civil lawsuit with the Haizhu District Court. Under the court's mediation, both parties reached a settlement agreement where the defendant compensated the victimized entity for all losses amounting to RMB 5,909. The victimized entity expressed forgiveness and requested leniency for the defendant.

The Haizhu District Court of Guangzhou ruled that Li Mouli intentionally damaged property of significant value, constituting the crime of intentional destruction of property, which should be legally punished. Considering that the defendant had compensated the victimized entity for all losses and received their forgiveness, the court decided to impose a lighter penalty on the defendant. Therefore, the court sentenced Li Mouli for intentional destruction of property, sentencing him to 4 months and 5 days of detention.
