Man Who Held Female College Student Hostage Sentenced to 10 Years in First Instance Trial

According to the indictment, defendant Li Jing was the ex-boyfriend of victim Guo and they had conflicts due to their breakup. At around 8:00 am on May 26, 2011, defendant Li Jing carried a spring knife to room 6-44 in Building B of the female dormitory of Yunnan Radio and Television University where he held Guo hostage. Li also claimed that he had explosives. At around 1:00 pm that day, police stormed into the dormitory to rescue the hostage. Li controlled Guo with the spring knife and was then subdued by the police on the spot. The indictment stated that defendant Li Jing held others hostage as part of a kidnapping, and the facts of the crime were clear and the evidence was sufficient. He should be prosecuted for kidnapping. However, given Li's relatively good attitude towards admitting his crimes and showing remorse, he can be punished less severely according to law. Accordingly, the indictment was filed against defendant Li Jing, requesting the court to sentence him according to law.

The court ruled that defendant Li Jing’s act of holding others hostage constituted kidnapping under Article 239 of the Criminal Law of the People's Republic of China. He should bear criminal responsibility and the charges brought by the prosecution were valid. After being arrested, defendant Li Jing truthfully confessed to the crime, showed a relatively good attitude towards admitting his crimes, and can be punished less severely according to law.

Defendant Li Jing admitted to all the charges. After trial and cross-examination, defendant Li Jing argued in verbal evidence that he did not put the knife on the neck of the victim, nor did he say anything about wanting to die together or request news coverage. His defense counsel argued that the defendant did not intend to harm the victim during the kidnapping. Considering that the defendant is a first-time offender and occasional offender, please lighten the punishment.

On February 10, 2012, the highly publicized case of the female college student hostage incident at Kunming University City was sentenced in the first instance at Chenggong District Court of Kunming City. Defendant Li Jing was found guilty of kidnapping and sentenced to ten and a half years in prison and fined 5000 yuan.
