Man disappears for 13 years after walking out of the detention center, family receives 120,000 yuan in compensation

Family Claims 560,000 yuan

On June 11, Zhou Xingming, the younger brother of Zhou Xingbing, rushed to Dayuqiao Police Station where officers asked him for 1200 yuan. Due to lack of money, he returned to Fang County. On June 13, the Public Security Bureau of Gucheng County made a decision to detain Zhou Xingbing at the county's detention center without his signature. On June 16, the Public Security Bureau of Gucheng County lifted the detention order.

On July 1, 2005, after continuous appeals by Zhou Xingming, the Public Security Bureau and Procuratorate of Gucheng County jointly replied to the Zhou family.

The court ruled that after capturing Zhou Xingbing, the Public Security Bureau of Gucheng County failed to process the necessary procedures restricting his personal freedom before making the detention decision, which was deemed as non-compliance. When processing the release from detention, the reason given in the approval form of the Public Security Bureau of Gucheng County was "no other criminal behavior found," whereas the notice of release stated "due to discovering his mental instability." The inconsistency between the two reasons led to the conclusion that the Public Security Bureau of Gucheng County should bear national compensation responsibility.

Last year on May 11, upon the application of Zhou Tianbao, father of Zhou Xingbing, the Fang County Court made a ruling declaring Zhou Xingbing dead. On June 26 of last year, Zhou Tianbao sued the Public Security Bureau of Gucheng County in court, claiming a total of 560,000 yuan in various compensations.

On June 17, Zhou Xingming rushed to Gucheng, where the police station informed him that Zhou Xingbing had gone missing.

After the first-instance judgment was made, both parties appealed. The Intermediate People's Court of Shiyan eventually dismissed the appeal and upheld the original verdict.

The Public Security Bureau's Release Procedures Were Incomplete

Zhou Xingming said that relevant departments had previously discussed the compensation issue with him. "They only agreed to compensate more than 20,000 yuan, but my brother's whereabouts were still unclear, and the truth of the matter wasn't clear either, so we didn't agree then." Afterwards, no one followed up on this matter.

Final Compensation of 124,000 Yuan

The reply clearly admitted at the end that the release procedures for lifting the detention of Zhou Xingbing by the Public Security Bureau of Gucheng County were incomplete, leading to his current unknown whereabouts.

In September of last year, the Fang County Court made a first-instance judgment, confirming that the specific administrative act of the detention decision made by the Public Security Bureau of Gucheng County was illegal, and ordered a compensation of 110,000 yuan to the Zhou family. Starting from June 10, 1996, each month they would pay 45 yuan as living expenses to Zhou Xingbing's parents until their passing.

A 21-Year-Old Man Goes Missing After Being Released From Detention

In early June 1996, 21-year-old Zhou Xingbing from Jundiandian Town, Fang County, left home and wandered to Gucheng County. On the morning of June 10, Zhou Xingbing held a kitchen knife in Dayuqiao Street, Gucheng, smashing the glass of someone else's car and threatening to kill people. After being controlled by the police, he was sent to the Dayuqiao Police Station (which has since been abolished).

For the next ten years, there was no trace of Zhou Xingbing.
