The services provided by Oriental Broadband will be carried out entirely in accordance with this user agreement and relevant instructions on the web pages. Users must fully agree to all the terms and complete the registration process to become an official member of Oriental Broadband.
II. Service Precautions
Oriental Broadband provides comprehensive broadband audio-visual network services to members through its own system platform via the international Internet, and part of it is a paid service. Therefore, users must:
1. Equip themselves with necessary devices for internet access, including personal computers or other essential internet access devices.
2. Apply for broadband internet access services on their own.
3. Bear the cost of personal internet access related to this service.
4. Bear the cost of using the paid services provided by Oriental Broadband and operate according to specific regulations.
Meanwhile, based on the importance of the network services provided by Oriental Broadband, users should agree to:
1. Provide detailed and accurate personal information.
2. Continuously update registration information to meet the requirements of timeliness, detail, and accuracy.
If users use the email service provided by Oriental Broadband, members should agree that Oriental Broadband can send product promotion, discount, or other related commercial service information to users through the email service system at irregular intervals.
Oriental Broadband does not disclose members' names, addresses, email addresses, and pen names, except in the following cases:
1. Members authorize Oriental Broadband to disclose these informations.
2. Relevant laws and procedures require Oriental Broadband to provide members' personal information.
If the information provided by members contains incorrect information, Oriental Broadband reserves the right to suspend or terminate the qualification of members to use network services.
III. Modification of Terms and Revision of Services
Oriental Broadband has the right to modify the terms of this agreement at any time without notice when necessary. Once there are changes in the terms of this agreement, Oriental Broadband will prompt the modification content on important pages. If members disagree with the changed content, they can actively cancel the obtained network service. If members continue to enjoy network services, it is considered as accepting the changes in service terms. Oriental Broadband reserves the right to modify or interrupt services without notifying members. Oriental Broadband's exercise of the right to modify or interrupt services does not need to be responsible to members, non-members, or other third parties.
IV. User Privacy Policy
Respecting members' personal privacy is a basic policy of Oriental Broadband. Therefore, as a supplement to the analysis of personal registration information mentioned in the second point above, Oriental Broadband will certainly not publicly disclose, edit, or reveal their registration information and non-public content saved in Oriental Broadband without members' authorization, unless there is a legal requirement or Oriental Broadband believes in good faith that disclosing this information is necessary in the following four situations:
1. Compliance with relevant legal provisions and adherence to Oriental Broadband's legal service procedures.
2. Maintaining and protecting Oriental Broadband's trademark ownership.
3. Protecting the privacy safety of members and the general public in emergencies.
4. Meeting other relevant requirements.
V. Member Accounts, Passwords, and Security
Once registered successfully, members become legitimate users of Oriental Broadband and will receive a password and username.
Members will bear full responsibility for the security of their usernames and passwords. In addition, each member must take full responsibility for all activities and events conducted under their username. Members can change their account passwords at any time, apply for new accounts, but cannot request to delete old accounts. Members agree to notify Oriental Broadband immediately upon discovering any illegal use of their account or security vulnerabilities. Members commit to follow the following rules when applying for an account:
1. The registration and use of usernames and Chinese nicknames must respect network ethics and comply with relevant laws and regulations of the People's Republic of China.
2. Usernames and Chinese nicknames must not contain any threatening, intimidating, abusive, vulgar, sacrilegious, sexual, obscene, illegal, contradictory, aggressive, harmful, harassing, defamatory, or insulting texts that infringe on others' intellectual property rights.
3. After successful registration of the username, members must keep their accounts and passwords safe to prevent theft or leakage.
4. Members must not use any means to steal or impersonate others' usernames, and bear the consequences of any adverse effects caused by such behavior.
5. Members must abide by this usage agreement and relevant instructions on the webpage when using the username registered on Oriental Broadband.
VI. Refusal to Provide Guarantees
Members personally bear the risk of using network services. Oriental Broadband makes no guarantees of any kind, whether explicit or implied. This includes, but is not limited to, Oriental Broadband not guaranteeing that the service will meet members' requirements; not guaranteeing that the service will not be interrupted; not guaranteeing the timeliness, security, or occurrence of errors in the service; not guaranteeing any commodity shopping services or transaction processes obtained on Oriental Broadband; and not guaranteeing any services provided by third parties on Oriental Broadband, etc.
VII. Limited Liability
Oriental Broadband assumes no responsibility for any direct, indirect, accidental, special, or consequential damages. These damages may arise from improper use of network services, purchasing goods or similar services online, conducting transactions online, illegal use of network services, or changes in information transmitted by users. Such behaviors may damage Oriental Broadband's image, so Oriental Broadband raises the possibility of such damages in advance. The maximum liability Oriental Broadband may bear towards members shall not exceed the service fees paid by members to Oriental Broadband during the period when Oriental Broadband's normal services cannot be obtained. This limited liability is consistently regarded by both parties as reasonable and sufficient compensation for the user's total loss.
VIII. Storage and Limitation of Member Information
Oriental Broadband is not responsible for the deletion or storage failure of information posted by members. Oriental Broadband reserves the right to determine whether a member's behavior complies with the requirements and spirit of Oriental Broadband's service terms. If a member violates the provisions of the service terms, Oriental Broadband has the right to interrupt the provision of network services to them.
IX. Member Management
Members solely bear the responsibility for the content they post. The use of services by members must comply with all national laws, local laws, and international legal standards applicable to Oriental Broadband. Users must adhere to the following:
1. Transmission of technical data from within China must comply with Chinese regulations.
2. Use of network services must not be for illegal purposes.
3. Do not interfere or disrupt network services.
4. Comply with all network protocols, regulations, procedures, and conventions for using network services. Members must commit not to transmit any illegal, harassing, slanderous, abusive, threatening, hurtful, vulgar, obscene information. In addition, members must not transmit any materials that incite others to commit criminal acts; must not transmit materials that promote domestic unfavorable conditions or involve national security; must not transmit any materials that do not conform to local regulations, national laws, and international laws. Unauthorized illegal entry into other computer systems is prohibited. If a member's actions do not comply with the service terms mentioned above, Oriental Broadband will independently judge and immediately cancel their account. Members are responsible for their actions on the internet. If a member spreads reactionary, pornographic, or other information violating national laws on Oriental Broadband, the system records of Oriental Broadband may serve as evidence of the member's violation of the law.
X. Guarantee
Members agree to safeguard and maintain the interests of Oriental Broadband, responsible for paying damages, litigation fees, lawyer fees, and other losses and expenses caused by exceeding the scope of services used by members.
XI. Interruption or Termination of Services
Members or Oriental Broadband can interrupt or end one or more network services at any time based on actual circumstances. Oriental Broadband has the right to interrupt or end services at any time without assuming any responsibility to members or other third parties. If members have objections to subsequent modifications of the usage agreement terms or are dissatisfied with Oriental Broadband's services, they can exercise the following rights:
1. Stop using Oriental Broadband's network services.
2. Notify Oriental Broadband to stop providing services to the member. After the termination of user services, the member's right to use network services is immediately terminated. From that termination, the member has no right, and Oriental Broadband has no obligation to transmit any unprocessed information or uncompleted services to the member or other third parties.
XII. Notice
All notices sent to members can be delivered through announcements on important pages, emails, or regular mail. Modifications to service terms, service changes, or notifications of other important events will be communicated in this manner.
XIII. Participation in Advertising Planning
Members who include promotional materials or participate in advertising planning in the information they publish, or display their products on Oriental Broadband's services, any such promotional methods, including transportation of goods, payment, services, business terms, guarantees, and descriptions related to advertisements, only occur between the corresponding user and the advertiser. Oriental Broadband assumes no responsibility and has no obligation to be responsible for such advertising sales.
XIV. Ownership of Network Service Content
The broadband integrated audio-visual network service content defined by Oriental Broadband includes: text, software, sound, images, videos, charts, all content in advertisements; the entire content of emails; and other information Oriental Broadband provides to members. All this content is protected by copyright, trademark, label, and other property ownership laws. Therefore, members can only use this content under the authorization of Oriental Broadband, the owner of the information and products, and advertisers, and cannot擅自copy, reproduce, download, spread this content, or create derivative products related to the content. All service contents of Oriental Broadband are jointly owned by the original copyright owner and Oriental Broadband. Anyone who needs to reprint the service content of Oriental Broadband must obtain the authorization of the original copyright owner or Oriental Broadband.
XV. Law and Jurisdiction
This usage agreement is consistent with the interpretation of the laws of the People's Republic of China. If any conflict arises between the service terms and the laws of the People's Republic of China, these terms will be reinterpreted entirely according to the law, while other terms will still remain legally binding and influential to members. Any disputes arising from the implementation of this service agreement, both parties agree to submit the dispute to the Shanghai Arbitration Commission for arbitration according to the then-effective arbitration rules of the commission. The arbitration decision is final and binding on both parties.
