A 75-year-old man was sentenced to life imprisonment in the first trial for drug trafficking

Yunnan Net reports (reporter Yang Zhihui, correspondent Zhang Yi): On November 4, 2011, the Kunming Railway Transportation Intermediate Court concluded a case involving a 75-year-old woman who transported 2824 grams of methamphetamine. The first-instance verdict sentenced the defendant Sun to life imprisonment, deprived her of political rights for life, and confiscated all her personal property. This case is the first criminal case judged by the Kunming Railway Intermediate Court according to the legislative spirit of "pitying the elderly" after the implementation of the Criminal Law Amendment (VIII).

Upon investigation by the court, it was found that Sun was born on February 17, 1936. On January 2, 2011, at noon, during the operation of passenger train K472 from Kunming to Wuhan in the Kunming to Qujing section, the police officers conducting a security check discovered suspicious signs from a female elderly passenger in the lower berth of carriage No. 7, which was the defendant Sun. During the inspection, they found fourteen packages of methamphetamine wrapped in transparent tape hidden in the lining of her floral cotton vest, with a total net weight of 2824 grams.

The court believed that the defendant Sun ignored national anti-drug laws, knowingly possessed drugs, and illegally carried 2824 grams of methamphetamine from Kunming intending to transport it to Wuhan by passenger train, thus violating national laws and constituting the crime of drug transportation. Although Sun transported a large quantity of drugs, which normally would warrant severe punishment, she was seventy-five years old at the time of trial, making her ineligible for the death penalty under the law. Moreover, after her arrest, she showed a relatively good attitude towards confession and demonstrated some remorse, allowing for a lighter sentence according to the law. Based on this, the Kunming Railway Transportation Intermediate Court legally made the aforementioned first-instance judgment.
