One of the victimized girl's parents successfully claimed compensation from Chen and his school. Recently, Daye Court made a first-instance judgment that Chen should compensate 31,855 yuan to the plaintiff Liu, and the school where Chen worked should bear joint liability for compensation.
Chen, aged 57, is an elementary school teacher in a town of Daye City. On March 18 this year, during class, Chen molested Liu, a six-year-old kindergarten student, twice.
Liu's parents believed that Chen sexually abused their child during teaching, not only damaging the child's physical health but also severely harming her innocent mind, causing immeasurable negative effects on her future growth. The elementary school where Chen works is also irrefutably responsible. Therefore, they sued the court and strongly requested that defendant Chen and his school bear the compensation responsibility, including medical expenses and mental distress compensation, totaling 36,191 yuan.
The court ruled that Chen's behavior of molesting children was extremely heinous. At the same time, the elementary school where Chen worked failed to fulfill its duty to protect students' personal safety and should bear joint liability for Chen's criminal acts. The court recognized the plaintiff's claims for mental distress compensation, transfer fees, and losses due to missed work and transportation costs incurred by Liu's parents when accusing the crime, amounting to 31,855 yuan.
