At this time last year, although he hadn't received a penny of his salary for 10 months, Wu Bingyue, aged 71, still carefully guarded the empty factory building of Jinhua Mountain Xiang Plastic Factory, diligently doing his own work. He was called "the most loyal security guard" by netizens. Recently, this good man finally received the court's mediation document, and there is hope to receive the 16,500 yuan in wages that had been withheld for 22 months. The boss, Shi Xiuchun, who is still detained in the detention center, clearly stated: "Old Wu has worked hard, I will definitely pay his salary!"
The court session was held in the detention center, and the mediation agreement was finally reached. "I just received the court's civil mediation document. Shi Xiuchun admitted to withholding my salary and promised to definitely pay me 16,500 yuan in wages in the future," said Wu Bingyue happily to the reporter.
After a year, the case of Wu Bingyue, "the most loyal security guard in history," whose wages were withheld, has finally made relatively ideal progress. On January 25, 2010, our newspaper reported under the title "Whether to return home for the New Year, the gatekeeper uncle is very conflicted" about how the gatekeeper Wu Bingyue, over seventy years old, hadn't received a penny of his salary for 10 months and couldn't even afford the electricity bill of dozens of degrees per month, yet still remained alone on the gatekeeper position of the bankrupt company. After the report was issued, many netizens praised Wu Bingyue as "the most loyal security guard in history."
Subsequently, the unpaid wages owed to Uncle Wu became the focus of attention from all sides. The person in charge of the mountain elephant plastic factory where Old Wu was guarding, Shi Xiuchun, was detained in the Xiangshan Detention Center in Ningbo on suspicion of illegally absorbing public deposits, so it was very troublesome to claim Wu Bingyue's wages.
At the end of 2010, a lawyer who provided free legal services for the case of Wu Bingyue's withheld wages submitted a complaint to the Wucheng District People's Court of Jinhua City, officially filing a lawsuit against Shi Xiuchun.
The judge handling this case rushed to Xiangshan, Ningbo on January 20 and held court in the detention center where Shi Xiuchun was detained, eventually reaching a mediation agreement.
Old Wu will get his salary at the first opportunity.
The mediation agreement clearly states: Defendant Shi Xiuchun shall pay plaintiff Wu Bingyue labor remuneration of 16,500 yuan from March 2009 to December 2010 (calculated at 750 yuan per month, totaling 22 months).
According to Wu Bingyue's attorney, during the trial, Shi Xiuchun expressed that he had heard the story of how Old Wu hadn't received a penny of his salary for a long time but still stood alone on the factory gatekeeper post, and he was very impressed by Wu Bingyue's behavior. He exclaimed: "Old Wu has worked hard, I will definitely find a way to pay his salary!"
However, despite the court's mediation decision, since Shi Xiuchun is still detained and currently has no money to pay, Wu Bingyue still cannot immediately receive the withheld salary.
Although he cannot receive the salary in time, after the court auctions off some of Shi Xiuchun's factories in Jinhua according to relevant procedures, his salary will be paid with priority.
Regarding this, Old Wu is also quite happy, because after all, he has already received the mediation document, and he will soon receive the money.
Currently, Old Wu has terminated his labor relationship with the plastic factory. He is now preparing to go back to his son's house to retire peacefully: "However, if there's an opportunity in the future, I will still go to the factory to take a look, because after I leave, there will be no one to take care of it, and I am still a little worried."
