Xinhua News Agency, Changsha - After the security guards caught a man they suspected of stealing from a construction site, they subjected him to private punishment by beating him, ultimately causing his spleen to shatter. The unit where the security guards worked compensated the victim with 100,000 yuan, and three security guards were brought to court for trial on charges of intentional injury. The case was heard in the Tianxin District Court, and the day before yesterday, the court made its first-instance verdict: the three security guards received sentences ranging from one year and five months to three years (suspended execution).
On July 6 at around 2 PM, at the Qianlong Academy construction site, on-duty security guard Zhang saw a man walking past the site with a bag on his back. He stopped the man and discovered that there were 13 fasteners used on the construction site inside the bag. Zhang thought the man was a thief and wanted to hand him over to the security team of the construction site. At this moment, Wang, the foreman responsible for the materials of the construction site, found out and hit the man's head with his mobile phone, also kicking the man's calf. Subsequently, Xu, Zou, Zhao and other security guards also arrived. The head of the security team instructed Zhang to take the man to the security team for handling. In the office, the man refused to admit to stealing. Seeing this, Xu, Zou, and Zhao surrounded the man and beat him with their fists and feet. A few minutes later, the man fell to the ground, shouting in pain. However, the security guards who had beaten him thought he "was pretending to be sick" and ignored him while continuing the beating.
Afterward, the man said that he couldn't bear the beating and admitted that the fasteners in the bag were stolen from the construction site. After the beating stopped, the man wrote a guarantee letter and paid a 400-yuan "fine" before being released. After leaving the construction site, the man found unbearable pain in his waist and abdomen, so he went to the hospital for examination and found out that his spleen had ruptured. On July 7, the man reported the incident to the Xinakpu police station. According to the forensic doctor's determination, the man suffered from a traumatic splenic rupture and abrasions on the right ankle joint, and had already undergone a splenectomy. His injuries constituted serious harm. On July 19, Xu, Zou, and Zhao were arrested by the police at the construction site.
After the incident, the unit where the three security guards worked reached an agreement with the man and compensated him with 100,000 yuan.
In court the other day, the three defendants Xu did not object to the prosecution's charges, admitting that they themselves did not see the man stealing goods but only heard others say that the man was a "thief."
Lawyer's reminder: "Whether it is law enforcers or the public, beating a thief resulting in injury or death may constitute a crime." Lawyer Liu Ming said that thieves also have legitimate personal rights, and apart from judicial authorities, no one has the right to deprive another person of life. If citizens defend themselves under the threat of a thief, they do not need to bear criminal, administrative, or civil responsibility; however, if it does not constitute self-defense, it may constitute negligent homicide, negligent infliction of serious injury, intentional injury, or intentional murder, requiring the bearer of criminal responsibility and civil compensation.
