We all know that if a website is inaccessible, it could be due to a fault of the website itself, or a telecommunications failure. In our case, there's also the possibility of the enigmatic GFW. The plaintiff in this case also understands that it was the GFW that caused the issue. However, for litigation strategy considerations, they chose the telecommunications company as the defendant, hoping for an indirect resolution. It may be easy to rule out the first possibility, but it’s difficult to determine between the latter two. Therefore, the key to the success or failure of the plaintiff in this case lies in whether there is evidence proving that the inability to access a certain website was due to the telecommunications side and not for any other reason.
