Legal Evening News reported on August 20th that this morning, Yu Bing, former director of the Beijing Municipal Public Security Bureau's Internet Monitoring Department, was sentenced to death with a two-year reprieve for multiple crimes, including symptoms of sinusitis. At 10 a.m., Yu Bing was brought into the court to hear the verdict. He, who had previously observed cases here as an audience member many times, did not expect that he would become the protagonist today. The judge announced the verdict, and Yu Bing was found guilty of embezzlement, bribery, and malfeasance in office, all of which were acknowledged by the court. The court sentenced Yu Bing to death with a two-year reprieve after considering all the crimes together. After the verdict was announced, Yu Bing did not indicate whether he would appeal. In February this year, Yu Bing, the former director of the Beijing Municipal Public Security Bureau's Internet Monitoring Department, was tried at the First Intermediate People's Court of Beijing on suspicion of embezzlement, bribery, and malfeasance in office. It was alleged that Yu Bing received bribes four times totaling more than 14 million yuan, all during his tenure as director of the Internet Monitoring Department. The Beijing Discipline Inspection Commission found that the "Oriental Microdot Spreading Computer Virus Case" orchestrated solely by Yu Bing was entirely fabricated. After receiving 4.2 million yuan from Rising Technology Co., Ltd., Yu Bing persecuted Microdot Software, Rising's competitor. It was understood that Yu Bing is fond of collecting antiques, and one of his methods of accepting bribes was to sell the antiques in his possession at high prices to companies that sought his favor. Yu Bing claimed that all the money he received as bribes was used to buy calligraphy and paintings, with a single painting costing over 2.5 million yuan. It was learned that when Yu Bing was a leader at the Shijingshan Public Security Branch, he often attended important criminal trials as an observer. However, he now stands trial as a defendant. Due to the harm caused by Yu Bing and Rising, Microdot Software's listing was delayed for nearly three years, resulting in economic losses exceeding 30 million yuan. A person responsible for public relations at Microdot stated that after the conclusion of Yu Bing's case, Microdot would initiate a compensation procedure. Case Review: The Internet Monitoring Director Accepted Bribes and Fabricated Evidence to Help Rising Harm Its Rival Liu Xu, once the general manager and chief engineer of Rising, left Rising in 2003 and founded Beijing Oriental Microdot Information Technology Co., Ltd. two years later. His deputy, Tian Yakuai, was also once the vice president of Rising. After Liu Xu resigned, the power of Rising fell into the hands of Wang Shen, who co-founded Rising with him. When Liu Xu's Oriental Microdot developed a new anti-virus product, Rising began to feel uneasy. According to information obtained from the Beijing Discipline Inspection Commission, Yu Bing accepted Rising's request just as Microdot was preparing its product for launch and blocked the new product from going to market. Under Yu Bing's instructions, the Internet Monitoring Department determined that Tian Yakuai had spread four viruses and arrested him. The Internet Monitoring Department announced that they had cracked the "first domestic case of an anti-virus company spreading viruses." After three years of appeals by Liu Xu, this case drew the attention of relevant departments. After investigation by the Beijing Discipline Inspection Commission, it was found that the claim that Tian Yakuai activated and spread four viruses was contrary to the facts. Upon investigation, it was discovered that Yu Bing was suspected of accepting bribes from Rising Company, and after the case broke out, he fled abroad to South Africa. On November 20, 2007, after being detained for 11 months and under house arrest for 12 months, the Haidian Procuratorate decided not to prosecute Tian Yakuai. In September 2008, Yu Bing was persuaded to return to China by the Supreme Procuratorate to accept the investigation and was arrested on September 18. (Legal Evening News)
