A woman in Zhengzhou forgot to retrieve her bank card after withdrawing money from an ATM. Subsequently, a man approached the ATM and within approximately 27 seconds, withdrew 3000 yuan from the woman's account before fleeing. By the time the woman realized and quickly reported the incident to the police, the officers stated that 3000 yuan did not meet the criteria for a credit card fraud case, and therefore would not investigate further. Yesterday, the woman called our newspaper stating that as of now, more than two months have passed since she reported the incident, yet the police have still not initiated an investigation.

However, up to now, Ms. Bai has visited the Xidajie Police Station no less than six times, and the case has still not been pursued.

The public security organs should investigate the infringer for the victim.

A woman in Zhengzhou forgot her card in an ATM while withdrawing money, and a man took 3000 yuan before leaving.

At this time, Ms. Bai had not yet left. About three minutes after the man left, Ms. Bai discovered her bank card was missing while checking her wallet. She immediately ran back to the ATM but found her card was gone. She quickly blocked the card and reported the incident to the police. However, at that moment, 3000 yuan had already been withdrawn from the card. The police who arrived at the scene stated that 3000 yuan did not meet the criteria for a credit card fraud case, and thus could not be investigated further.

Not meeting the criteria for investigation, unable to initiate an investigation.

Yesterday, the surveillance video provided by Ms. Bai showed that just as she turned around, a middle-aged man with a black suitcase, wearing a red and black quilted jacket and black pants, quickly approached the ATM where she had just withdrawn money. After glancing at Ms. Bai standing nearby, he began operating the machine, then quickly left with his suitcase. This entire process lasted about 27 seconds.

Ms. Bai said, "I will not give up on this matter. Now, for me, it is no longer just about the money that I keep insisting on. I just want to find out clearly, if similar incidents happen again in the future, which department should I turn to? Even if it does not meet the fraud case standard mentioned by the police, shouldn't the police help investigate after such an incident occurs?" F

On November 20, 2011, at 10:11 AM, Ms. Bai, a citizen of Zhengzhou, went to an ATM located near the intersection of Xidajie and Nanshunchengjie to withdraw money. After withdrawing the money, she forgot to remove her card and turned around to organize her wallet next to another adjacent ATM.

Yesterday afternoon, Officer Li Daji from the Zhengzhou Public Security Bureau Xidajie Police Station, who was handling this case, told reporters that this incident did not constitute a criminal case but rather fell under economic investigation related to credit card fraud. The criteria for establishing cases vary in different regions; in Henan, the threshold for this type of case is 5000 yuan. Therefore, this matter cannot be established as a case, and without a case being established, it is impossible to retrieve surveillance footage. However, the day after the incident, they also obtained photos of the surveillance video through private channels for Ms. Bai to see, but Ms. Bai was not satisfied and wanted to retrieve the complete video, which they were unable to do. "Later, we retrieved the surveillance under the name of another case for Ms. Bai," the officer said. "Even if this case had been established, there are no clues, so where would we look?"

Out of desperation, Ms. Bai reported the matter to the higher authorities of the police station. It wasn't until more than a month later, on December 31, 2011, when the higher authorities revisited her during a reception day, that the Xidajie Police Station officers helped her retrieve the surveillance footage from the bank.

Yan Bin, the director of Henan Yan Dongfang Law Firm, said that the judicial interpretation of the Supreme People's Court has categorized this type of case as credit card fraud, but the criteria for establishing such a case is 5000 yuan or more. Therefore, this incident does not constitute a criminal case and can generally be handled as a civil case or public security case. As public security organs responsible for protecting the lives and property safety of the people, they should place the interests of the public first and provide maximum assistance.
