Deputy Director of the Danleng County Public Security Bureau and Director of the Traffic Police Team Respond to Questions: There is No "Favoritism Case"
Follow-up on the Investigation of Deputy Director of Danleng Water Conservancy Bureau for "Drunk Driving"
Under the supervision of the Provincial Department of Public Security's Traffic Police Corps, the matter of Deputy Director of Danleng Water Conservancy Bureau, Su Renxun, only receiving administrative punishment for "drunk driving" has finally been completely rectified. Currently, Su's case has been transferred to the procuratorate.
Yesterday, in response to the doubts raised by legal experts regarding the "favoritism case," Deputy Director of Danleng County Public Security Bureau and Director of the Traffic Police Team, Luo Haojie, met with reporters from Huaxi Metropolis Daily. Regarding the driver who fled after causing a fatal accident and was found not to have consumed alcohol, he stated that there is no "favoritism" or "connection" involved; it was entirely due to a misunderstanding of the legal provisions regarding "criminalizing drunk driving."
Case Progress: Su Renxun Has Been Released on Bail
Huaxi Metropolis Daily: Could you introduce the current progress of Su Renxun's case?
Luo Junjie: On the 24th, after the Meishan Municipal Public Security Bureau Traffic Police Corps intervened in the investigation, they legally revoked our previous administrative penalty decision. The team immediately proceeded with further investigations into Su Renxun's case according to the legal provisions of "criminalizing drunk driving." Since Su Renxun is suspected of committing the crime of "dangerous driving," this morning, we have transferred the case to the Danleng County People's Procuratorate and requested prosecution. Given that Su Renxun is an employee of a unit, according to legal provisions, we have taken measures to release him on bail, with one of the leaders from the Water Conservancy Bureau acting as his guarantor.
Huaxi Metropolis Daily: Apart from Su Renxun's case, the Danleng Traffic Police Team also investigated three other cases suspected of drunk driving. How are these three cases progressing?
Luo Junjie: On the evening of May 3rd and May 11th, the team caught three drunk drivers. Especially on the evening of May 3rd, traffic police apprehended Xu Li (a pseudonym) from Guangji Township, Dongpo District, Meishan City, in a vehicle parked by the roadside. Blood sample test results showed that Xu Li's blood alcohol concentration was 180mg/100ml. However, at the time, Xu Li was not driving on the road; although he was drunk, there was insufficient evidence to prove whether Xu Li had driven a motor vehicle. The situations of the other two individuals are similar. Therefore, these three individuals have not yet been transferred to the procuratorate for prosecution. After further investigation and evidence fixation, we will transfer the case to the procuratorate as soon as possible.
Is it a Favoritism Case? This Case Does Not Exist
Huaxi Metropolis Daily: After Su Renxun's case was exposed, some legal experts questioned whether Danleng handled a "favoritism case." Is there really any "favoritism"?
Luo Junjie: In Su Renxun's case, subjectively speaking, as the director of the traffic police team, instructor, or investigating officer, giving private favor to Su Renxun does not exist. After Su Renxun's case occurred, I, the instructor, and the investigating officers still referred to the "Amendment (VIII) to the Criminal Law of the People’s Republic of China" while handling this case. At the same time, according to legal provisions, we completed all investigative procedures and formed a complete chain of evidence. Therefore, our traffic police absolutely did not handle a "favoritism case" or "relationship case."
Huaxi Metropolis Daily: Subjectively, it doesn't exist, but objectively, does it exist?
Luo Junjie: Objectively, there is also no "relationship" or "favoritism."
Huaxi Metropolis Daily: After Su Renxun's case happened, did anyone try to intercede for him?
Luo Junjie: No. During the investigation process, only the leader of Su Renxun's unit contacted me. When the leader of the unit reached out to me, I thought it was entirely reasonable since Su Renxun is part of the unit.
Where Did We Go Wrong? Misunderstanding of the Law
Huaxi Metropolis Daily: Regarding Su Renxun's case, the traffic police team issued an administrative penalty. Where did we go wrong?
Luo Junjie: To be honest, after Su Renxun's case occurred, we should have processed it as a "drunk driving" case according to the "Amendment (VIII) to the Criminal Law of the People’s Republic of China." However, during the handling of the case, Deputy Chief Justice Zhang Jun's statement was published. After the blood sample test results came out, our understanding of the law was insufficient. Additionally, considering his good attitude towards confessing, we rashly believed that Su Renxun's actions were relatively minor and aligned with Zhang Jun's statement that "drunk driving does not always lead to criminal charges," so we penalized him based on the "drunk driving" standard. The mistake lies in our deviation and inadequacy in understanding the law. Reasonably speaking, as enforcement officers, making such errors should never happen.
