Former CEO Sues Magazine for Defamation and Loses

Mr. Chen stated that in the fifth issue of the "China E-Commerce" magazine in 2011, an article titled "We Are No Longer Brothers" plunged him into a crisis of reputation. In this article, Mr. Chen was portrayed as someone who misappropriated company assets through unauthorized salary increases and irregular reimbursements, eventually being "swept out" by the company as a dishonest person. He was also evaluated by relevant individuals as "possessing all five poisons" and "shameless to the extreme." Mr. Chen believed that the article "Brothers" exaggerated the disputes between him and the company, damaging his reputation, and should bear civil liability.

After investigation, the court found that Mr. Chen's reimbursement accounts during his tenure indeed contained irregularities, and he had been placed under bail measures by the public security organs after being reported for suspected embezzlement of official duties. Combining these facts, it can be determined that the content recorded in the article "Brothers" is basically true. Although the phrase "possessing all five poisons" was cited in the published article, this term was quoted from others and not the author's evaluation of Mr. Chen. Therefore, the article "Brothers" did not constitute an infringement of Mr. Chen's right to reputation. Finally, the court rejected his lawsuit request.

Yesterday, when the reporter searched on Baidu, the involved article could still be found online. According to the article, after the incident involving suspected embezzlement of official duties, Mr. Chen was relieved of his position as CEO of Beijing Lianlong Technology Co., Ltd.
