Beijing Morning Post (Reporter Xin Wu) - Yin was injured in a nightclub and, to vent his anger, he instructed his friend Liang to retaliate against the perpetrator. Liang gathered others and went to a restaurant in Jiugong Town, Daxing District, to find the person who had injured Yin. However, they attacked the wrong person - they ended up killing the restaurant owner and injuring a customer. After the incident, Liang fled and was on the run for many years until he was arrested by the police. Yesterday, Liang appeared in court at the Beijing No.1 Intermediate People's Court.
On May 6, 2007, Yin was drinking with "Brother Hai" and others at an entertainment venue. Yin recalled that during this time, "Brother Hai's" friend Liu beat him. Following the incident, Yin was sent to the hospital for treatment. On the same day, Yin called his friend Liang and told him that he had been beaten. Liang said that he later saw Li and others at the karaoke lounge owned by Yin discussing plans to get revenge for Yin. Soon after, Liang received a call from Gao, saying that they had found the person who injured Yin; it was a bald man. Li and others armed themselves with machetes and wooden sticks and, under Gao's guidance, drove to a home-style restaurant in Jiugong Town, Daxing District.
That night, victim Zhang was eating at the restaurant when suddenly Li and others rushed in with knives and clubs and began attacking Zhang. Zhang shouted: "You've got the wrong person, it's not me!" However, Li and others did not stop. In the ensuing chaos, Zhang managed to escape from the restaurant.
Local vendors around the restaurant told investigators that the restaurant owner was surnamed Gao and was bald. At the time of the incident, several men stormed into the restaurant, all armed. The sound of breaking things could be heard from inside the restaurant. Later, this group of people ran out of the restaurant. The restaurant owner, Mr. Gao, was helped out by his family, bleeding heavily. Mr. Gao kept muttering: "I haven't offended anyone." Eventually, due to severe injuries, Mr. Gao passed away. The injured customer, Zhang, survived.
After the incident, Liang fled. It wasn't until July 2011 that the police captured him in a residential house in Tieling, Liaoning Province, and brought him back to Beijing. During Liang's escape, his accomplices had already been sentenced, with Li being given a suspended death sentence.
In court, Liang admitted his guilt. Liang's defense attorney presented a civil mediation agreement. Liang's relatives had already compensated the victim's family with 130,000 yuan, and the victim's family expressed their understanding of Liang, withdrawing their civil lawsuit against him. The prosecutor argued that defendant Liang conspired with others to intentionally harm another person's body, resulting in one death and one light injury, and should be held criminally responsible for intentional injury. Considering that Liang's family had compensated the victim's family and both sides had reached an understanding, a lighter punishment for Liang could be considered. However, the prosecutor noted that "Liang's attitude towards confessing during the trial was poor, and it is recommended that the court sentences Liang to between 12 to 15 years in prison."
