According to foreign media reports, a private technology company recently filed a lawsuit in court, claiming that Motorola Mobility stole a source code related to mobile technology from it and used this intellectual property for its own commercial benefit.
The technology company is named Lemko. It claims that Motorola Mobility hired away an engineer responsible for developing this source code and transferred this intellectual achievement to its branch in China. A spokesperson for Motorola Mobility stated that the company has not yet received the complaint, so it is temporarily inappropriate to comment.
This source code is related to a technology called "positioning system," which involves how mobile phones determine their location through satellite signals. This technology, combined with cell phone towers, can support services like Google Maps and Foursquare.
In this lawsuit, Lemko claims that Motorola Mobility admits that Lemko's source code is on its servers but attempted to transfer this code to its laboratory in China, thereby concealing the existence of this source code. Lemko also claims that this source code has already been applied to at least one model of Motorola mobile phone.
This lawsuit could threaten Google's $12.5 billion acquisition of Motorola Mobility. Lemko claims it will set obstacles for the transaction between these two companies. "Lemko is dedicated to preventing its software from being stolen," said the company's spokesperson in a statement. "Lemko will actively protect its intellectual property and exercise legal rights to prevent Motorola from illegally selling and transferring our source code to Google."
These two companies have been embroiled in litigation for years. Previously, Motorola Mobility sued Lemko, claiming the latter stole its trade secrets. Motorola Mobility claimed that employees secretly recruited by Lemko provided many of Motorola's key trade secrets to Lemko. Last week, Lemko also sued Motorola Solutions, claiming the company interfered with its business.
At the beginning of this year, Motorola split into Motorola Mobility and Motorola Solutions. Motorola Mobility is responsible for mobile phones and set-top boxes, while Motorola Solutions focuses on public safety networks and enterprise mobile equipment.
