Wuhan female judge abuses litigant and challenges to a duel

By reporter Yongjun Zhang, correspondent Fa Yang

A woman went to court to file an accident compensation case which was not accepted. She then quarrelled with the judge and cursed at each other on the spot. The judge even threatened to "duel" with the litigant. Mr. Huang posted online about the "most shocking female judge in Wuhan" and released related videos. This post quickly caused a stir.

Yesterday, the court of Hanshou District apologized to the parties involved and made a decision to give the judge involved a reprimand and transfer her from her current position. The leadership of the court expressed that they will use this as a lesson to carry out special law enforcement rectification.

Refusal to accept the case leads to a quarrel with the judge

According to Mr. Huang who posted the information, Ms. Chen was filing the case on behalf of the car owner Mr. Cheng. Not long ago, Mr. Cheng drove a Wuhan-registered Hyundai SUV and collided with a local Fukang car in Jiangxi. The local traffic management department determined that both parties were equally responsible. However, the other party refused to cooperate with him to handle the insurance claim at the affiliated Hanyang insurance company.

Mr. Cheng decided to sue the Hanyang insurance company, the other party involved in the accident, and their affiliated insurance company together. According to the litigation law, the parties have the right to sue at the court where the infringing defendant is located. On September 1st, due to his busy schedule, after writing the complaint, Mr. Cheng entrusted Mr. Huang and Ms. Chen to help file the case at the court of Hanshou District.

Unexpectedly, the court rejected the case on the grounds that the accident did not occur within its jurisdiction. As a result, Ms. Chen quarrelled with a female judge in the registration office and cursed at each other on the spot.

The 6-minute video is filled with cursing

The online video lasts for 6 minutes and 10 seconds. In the video, Ms. Chen, dressed in white, curses through the glass at a female judge inside the registration office. The female judge, around 30 years old, wearing the national emblem, repeatedly approached the glass, pointing at Ms. Chen, shouting: "XXX raised you, like your mother's XXX..." The foul language continued endlessly, unbearable to listen to. Ms. Chen also retaliated with curses. Throughout the process, no one came out to mediate.

Mr. Huang said that the behavior of the female judge was beyond his imagination. Afterwards, he and Ms. Chen complained to the court's supervision room. Subsequently, he went home and added textual materials to the video he had just taken, posting it online.

Court's handling: Transfer the involved judge

This post quickly caused a stir online, netizens discussed it extensively. A netizen on Tianya Network believed that regardless of the cause of the incident, staff cursing at the window damages the image of the court.

In response, the court of Hanshou District explained that at 9 o'clock on the morning of September 1st, Ms. Chen went to the registration office of the court to apply for registration on behalf of Mr. Cheng. After preliminary review by the registration personnel, the case occurred in Jiangxi, and Ms. Chen did not have authorization from the parties involved. The judge in the registration office explained the relevant legal provisions of the jurisdiction of such cases to Ms. Chen and suggested that she go to Jiangxi to register. This led to a quarrel between them.

After the incident, the court of Hanshou District organized a team to investigate the matter. Relevant leaders of the court actively contacted Ms. Chen and apologized for the uncivilized behavior of the judge involved.

Yesterday morning, the court of Hanshou District held a meeting, criticizing the uncivilized behavior of the judges in the registration office when receiving visitors. It was decided to give the involved judge an administrative reprimand and transfer her from her current position.
