Justice Network, Anhui, September 6th (Correspondent Li Jianfei) - A wedding had already been held according to rural customs, but a marriage certificate was never obtained. The "husband" wanted to initiate a child-making plan with the "wife," but the "wife" refused to comply. Recently, the Lixin County People's Procuratorate of Anhui Province has legally approved the arrest of the suspect Wang for alleged rape.
Wang, from Jiwangchang Township in Lixin County, born in 1991, dropped out of school after the fifth grade. He has some mental issues and suffers from hernia. His parents, seeing their son's congenital defects, hoped he would marry early and have children. Later, through an introduction, Wang met He from Wenshan Zhuang and Miao Autonomous Prefecture in Yunnan Province.
On June 26th, 2010, according to the lunar calendar, Wang's parents held a wedding ceremony at home for Wang and He following local customs. Around 11 p.m., He did not want to take off her clothes to sleep, so Wang forcibly tore her blouse and stripped her naked. He, bare-chested, jumped from the second-floor bedroom window onto the kitchen roof, where there were blankets. She spent the night sleeping on the kitchen roof. The next evening, when He was in the bedroom on the first-floor staircase, Wang, together with his father (who has since been placed under surveillance), tied her legs with ropes to one end of the bed and bound her hands to the other end. When He shouted loudly, Wang struck her with his hand. After Wang's father left, Wang stripped He completely and forcibly had sexual intercourse with her.
The prosecutor handling the case believes that according to China's Marriage Law, both spouses have the obligation to be faithful to each other. In this case, although Wang and He had already held a wedding according to custom, they had never registered their marriage, thus lacking a legal marital relationship. Wang violated He's will, using violence and other means to forcibly have sexual relations with her, constituting rape.
