People with common sense all know that if a car is cut off while driving, it is very likely to cause a traffic accident, and it is almost inevitable that the travel time of the car being cut off will be delayed. But if the vehicle that got cut off is a fire truck on its way to rescue, then what will be lost could be the opportunity to save countless lives!
What is disturbing is that when the reporter contacted the local fire department, it was learned that almost every firefighter in Huai'an has experienced being cut off or overtaken by other vehicles while responding to a fire alarm.
Firefighters: Being cut off during firefighting is a common occurrence
"Whenever we're in the urban area, we encounter this situation every time we respond to an emergency, especially during rush hours. Some cars 'seize every opportunity', rushing forward as soon as they see a gap, completely ignoring the sound of the fire truck's siren." When asked whether the fire rescue team was overtaken during their mission, Instructor Guo Zhiming of the Chengxi Fire Station of Huai'an Fire Brigade expressed his helplessness.
Guo Zhiming introduced that just a few days ago, the Chengxi station responded to an emergency at Liberation West Road. While driving urgently, a private car suddenly cut in front of the fire truck attempting to overtake it. Unfortunately, due to incorrect judgment, the rearview mirror of the private car scraped against the fire truck and fell off. Upon seeing this, the private car driver immediately blocked the front of the fire truck, demanding an explanation. In order not to delay the response time, the firefighters reluctantly took out 200 yuan as compensation, allowing them to continue forward.
"The public's awareness of rescue is too poor. Nowadays, many drivers have no reaction to the sound of sirens, and overtaking and cutting in are common occurrences; in some residential areas, fire lanes are often occupied, causing great inconvenience to fire rescue operations. Of course, this is also related to the current laws in our country. Currently, relevant laws impose too light penalties, and the cost of breaking the law is too low. I believe that severe punishment must be given to stop these illegal behaviors," Guo Zhiming expressed his concerns.
Traffic Police: Citizens need to enhance legal awareness
During the firefighting process, the fire truck was cut off. As the regulator and guarantor of road safety, how do the traffic police view this? Recently, the reporter interviewed Deputy Chief Ji Shuyang of the Legal Affairs Publicity Division of the Municipal Public Security Traffic Patrol Police Detachment regarding this issue.
Ji Shuyang believes that the root cause of such phenomena lies in the weak traffic legal awareness of some citizens and their lack of understanding of basic laws and regulations.
Ji Shuyang introduced that in order to ensure that ambulances, fire trucks, and other special vehicles in our city can quickly, safely, efficiently, and orderly reach the scene during urgent tasks such as critical injury rescue, fire fighting, disaster relief, and major emergency handling, thereby promptly implementing emergency rescue work and minimizing casualties and property loss, Huai'an City launched the "Green Life Channel" project last May.
In the "Green Life Channel" project, our city uses the "110 Emergency Service Platform" as the foundation to build a new integrated emergency communications and command scheduling platform for functions such as emergency medical assistance, fire handling, accident rescue, disaster prevention, and major emergency response. This allows various sudden situations to be communicated or notified to all relevant units in the first instance. After receiving instructions or notifications, all relevant units implement their responsibilities within their scope according to the contingency plan. Especially regarding traffic order assurance, the project explicitly requires the public security traffic patrol police department to quickly mobilize nearby police forces based on the route of the fire truck or ambulance, rush to the relevant roads for deployment and control, strengthen command and guidance, and fully maintain traffic order. Other vehicle drivers should actively yield and detour to reduce traffic pressure at congested points and prevent large-scale traffic jams.
Lawyer: Relevant laws lack clear details
"This is closely related to the current situation in our city where the number of private cars is increasing and traffic congestion is becoming more prominent. At the same time, it also reflects the weak legal awareness and public consciousness of some citizens, whose quality needs improvement," analyzed Tian Jinsong, Deputy Director of the Huaiyin District Legal Aid Center and lawyer.
Tian Jinsong introduced that the Road Traffic Safety Law clearly states that vehicles executing emergency tasks such as police cars, fire trucks, ambulances, and engineering rescue vehicles cannot be overtaken.
Article 47 of the Fire Control Law also clearly stipulates that when fire trucks and fireboats are heading to execute fire extinguishing or emergency rescue tasks, other vehicles, vessels, and pedestrians should yield and not cut in or overtake.
In Article 62 of the Road Traffic Law, it is stated that behaviors such as overtaking and obstructing fire trucks from performing their duties can be penalized according to Article 50 of the Public Security Administration Punishment Law of the People's Republic of China: a warning or a fine of less than 200 yuan; for serious cases, detention of more than five days but less than ten days, possibly accompanied by a fine of less than 500 yuan.
Lawyer Tian believed that according to relevant laws, public security organs can definitely impose penalties on vehicles that illegally drive through or overtake convoys of police cars, fire trucks, ambulances, and engineering rescue vehicles performing emergency tasks. However, in practice, due to the urgency of firefighting, traffic police and firefighters don't have time to deal with overtaking vehicles; whether there were conditions for yielding, whether the driver intentionally blocked or was negligent, etc., are all somewhat controversial. Moreover, the enforcement of the regulations lacks clear details, making it difficult to implement relevant laws.
