After deliberation, the Higher People's Court of Shaanxi Province held that the facts of Yao Jiaxin's intentional homicide were clear, and the evidence was solid and sufficient. After Yao Jiaxin ran over the victim Zhang Miao with his car, he killed her to avoid responsibility, constituting intentional homicide. Four days after the crime, Yao Jiaxin surrendered to the public security organs accompanied by his parents, truthfully confessing his crimes, which constituted self-surrender. However, after running over the victim with his car, Yao Jiaxin killed her to cover up his tracks, stabbing her continuously in the chest, abdomen, back, etc., with a sharp knife, causing her death on the spot. His motive for committing the crime was extremely despicable, his means particularly cruel, the circumstances especially heinous, and the crime extremely serious. Even though he was a first-time offender, an occasional offender, and had turned himself in, it was still insufficient to warrant a lighter punishment. Therefore, his appeal reasons and the defense counsel's opinions were not adopted. The opinion of the Shaanxi Provincial People's Procuratorate was correct and was adopted. The original trial accurately determined the crime, appropriately sentenced, and followed legal procedures, so the court ruled to reject Yao Jiaxin's appeal, uphold the original verdict, and submit it to the Supreme People's Court for approval.
