Huaren Paint becomes a "China Famous Brand" in its IP enforcement actions
“Famous brand”, is a trademark with high popularity and reputation in the country. Compared to ordinary trademarks, the legal protection scope for famous brands is wider and stronger. On April 25th, the State Administration for Industry and Commerce announced a list of newly recognized famous brand enterprises. Among them, Guangdong Huaren Paint Co., Ltd., a leading company in the coatings industry that has been deeply troubled by "brand riding", was also on the list, and "Huaren Paint Huarun and Figure" was recognized as a famous brand. It is understood that international protection of famous brands started after the establishment of the Paris Convention for the Protection of Industrial Property by European and American countries in 1925. The purpose of protecting famous brands is to safeguard the legitimate interests of brands with high added value from infringement, protect the legitimate rights and interests of trademark owners, improve the intellectual property protection system, encourage independent innovation, optimize the innovation environment, maintain market competition order, and play a very important role in promoting the rapid and sustainable development of the economy and society. Since joining the Paris Convention for the Protection of Industrial Property in 1985, China has begun to fulfill its obligation to protect famous brands. The Trademark Law revised in 2001 and the subsequently issued Implementing Regulations of the Trademark Law provided clear legal basis for the recognition and protection of famous brands.
Experts point out that all enterprises recognized as "famous brands" are relatively strong in technology, quality, and corporate brand strength in their industries, and have a good reputation, consumer appeal, and strong market competitiveness. Therefore, these companies are also the most likely to be counterfeited and infringed upon by illegal manufacturers. Taking Huaren Paint as an example, in March this year, Huaren Paint launched a nationwide campaign against "brand riding". The legal department of Huaren Paint Group went to various provinces and cities such as Beijing, Jiangsu, Fujian, Sichuan, Yunnan, Hubei, and Jiangxi, cooperating with local industrial and commercial departments in anti-counterfeiting and rights protection actions. By March 16, 2009, the industrial and commercial departments across the country had seized more than 2,500 pieces of counterfeit Huaren Paint infringing products, over 10 types of suspected infringing counterfeit products, involving an amount of over 300,000 yuan.
Fang Xin said: "In recent years, as Huaren Paint products become better and our enterprise grows larger, we also feel that the resistance to development is becoming greater. We have to develop new technologies and products to grow our business while fighting against counterfeit and substandard products and cleaning up the market environment. These have somewhat diverted the company's attention and greatly damaged its economic interests and brand image. More seriously, counterfeit paint products pose a serious threat to the life and property safety of consumers."
