Provisions on the Procedure for the Administration for Industry and Commerce to Stop the Abuse of Administrative Power to Eliminate or Restrict Competitive Behavior

Article 2: Where administrative organs and organizations authorized by laws and regulations with the function of managing public affairs abuse administrative power to implement acts that exclude or restrict competition, they shall be ordered to make corrections by their superior organs; persons-in-charge directly responsible and other persons directly responsible shall be disciplined according to law. The State Administration for Industry and Commerce and the Industry and Commerce Bureaus of provinces, autonomous regions and municipalities (hereinafter referred to as provincial industry and commerce bureaus) may submit suggestions for handling according to law to relevant superior organs.

Article 3: In cases where departments under the State Council and people's governments of provinces abuse administrative power to exclude or restrict competition, the State Administration for Industry and Commerce may submit suggestions for handling according to law to the State Council.

In cases where organizations authorized by laws and regulations with the function of managing national public affairs abuse administrative power to exclude or restrict competition, the State Administration for Industry and Commerce may submit suggestions for handling according to law to organs administering such organizations.

Article 4: In cases where departments under the people's governments of provinces, local people's governments below the provincial level and their departments under them abuse administrative power to exclude or restrict competition, the provincial industry and commerce bureau may submit suggestions for handling according to law to relevant superior organs.
