Kodak stated that the company has reached a certain level of agreement with Apple regarding the attribution of a specific patent in a timely manner. However, Kodak does not agree with Apple to submit the case to a federal district judge and restart the suspended action; instead, they prefer to directly submit the matter for trial to the bankruptcy judge. In court documents released on February 14, Apple claimed "irreparable loss." Apple argued that part of Kodak's assets must be sold under certain conditions, specifically this portion of patents, to repay its $950 million bankruptcy loan. The value of these patents is estimated between $2.2 billion and $2.6 billion.
Apple, SAN FRANCISCO, March 6, according to foreign media reports on Monday, Eastman Kodak (microblogging) (hereinafter referred to as Kodak) is facing interference from a group that opposes the sale of over $2.6 billion worth of digital imaging patents. Apple last month planned to restart litigation against a Kodak patent because the company claims that this patent should belong to Apple. There is concern that Kodak’s bankruptcy may incorrectly result in these assets being sold to other companies.
In court papers on Friday, Apple continued its major patent litigation against Kodak, arguing: "to maximize the value — this means it should be left unchecked." Considering the patent litigation in District Court gives Kodak a negative impact on this argument. Apple alleges that this practice is tantamount to gaining a tactical advantage and thus taking the initiative to ask the court for settlement concerning digital imaging technology patents.
