Recently, the Beijing Dongcheng District People's Court made an influential ruling concerning Dangdang. In 809 cases, the majority of orders placed by consumers and not confirmed by Dangdang were deemed not established; another smaller portion of the orders, for which Dangdang had sent a confirmation email regarding the shipping status, were considered valid contracts. This case provides information and reference for the handling of future related events in the field of e-commerce, garnering significant attention. Through the first-instance verdict of the Beijing Dongcheng Court, part of the consumer's claims were supported, but most were not. From a legal judgment standpoint, there was no absolute winner. The court categorized the canceled orders from Dangdang into two types: one where consumers had placed an order with Dangdang confirming delivery but not issuing it, leading to cancellation afterward; the other where Dangdang did not confirm the consumer’s submitted order. For the first category, the court ruled that the contract was established, favoring the consumer. For the second category, the court recognized that Dangdang did not confirm the order, thus the contract was not established, and compliance could not be demanded from Dangdang. Such contracts should indicate that Dangdang’s actions have been supported by the court. Another signal revealed by this case is that the development of online retail and corporate manual input errors are inevitable. Historically, such incidents have occurred more frequently. If all e-commerce enterprises were held strictly liable for such errors, it would be too harsh and not in line with the rule of law, hindering the growth of the e-commerce industry. According to the judgment, whether or not a confirmation email was issued determines if the contract takes effect, identified according to trading rules. If companies did not issue a confirmation email, the contract cannot be established. Overall, Dangdang's behavior has been widely recognized by the court. Additionally, society and public opinion have shown tolerance towards e-commerce businesses, creating a good social environment for an objective and rational evaluation of the e-commerce industry. Dangdang has made its due contribution in this regard.
