According to reports (reporter Hong Xue), in order to conceal the use of money from her husband, a wife actually had someone make a fake passbook for her. Unaware, the husband took the passbook to the bank to withdraw money, prompting bank staff to report it to the police on the spot.
This morning, it was learned that due to suspicion of forging financial securities, Fangshan Procuratorate has brought charges against Ms. Liang. In October 2010, Ms. Liang and her husband Mr. Zhang planned to deposit 160,000 yuan earned from selling their house into the bank. Due to the large number of people at the bank that day, they were unable to make the deposit.
Afterwards, Mr. Zhang asked Ms. Liang to deposit the money in the bank. However, Ms. Liang secretly invested these 160,000 yuan into her cement business without her husband's knowledge. To prevent Mr. Zhang from discovering the truth and causing an argument, Ms. Liang searched online for someone who could make fake tickets, and made a fake passbook which she then handed over to her husband.
At the end of May 2011, in order to pay for his sister's surgery, Mr. Zhang took this fake passbook to the bank to withdraw money. After confirming that the passbook was counterfeit, the bank branch reported it to the police. Upon questioning, Ms. Liang was summoned to the case.
Currently, Ms. Liang, suspected of forging financial securities, has been prosecuted by the Fangshan Procuratorate towards the Fangshan Court.
● Prosecutor's Explanation
Prosecutor Huang Xuhui of Fangshan Procuratorate stated that in this case, although Ms. Liang did not personally forge the bank passbook, she actively contacted the counterfeiters and provided them with specific information needed for forgery, thus constituting a joint crime with the counterfeiters. She should be held criminally responsible for the crime of forging financial securities.
Originally, Ms. Liang intended to immediately deposit the money as soon as her business made money, and did not have the subjective intent to commit a crime. However, her actions infringed upon the subject of national financial order, and objectively, she has already disrupted the financial order.
