In June 2007, Ms. Zhang, a teacher from a key middle school in Chongqing, and her husband were passing by Yangjiaping Zhi Gang Avenue when a 40-kilogram Tibetan Mastiff jumped from the 9th floor and landed on Ms. Zhang. The dog died on the spot, while Ms. Zhang fell into a coma and was rushed to the hospital for emergency treatment. In March 2008, Ms. Zhang filed a lawsuit demanding compensation of over 1.53 million yuan from the dog's owners, Mr. and Mrs. Yan, including 760,000 yuan for nursing fees and 300,000 yuan for mental distress. After deliberation, the court ruled in the first trial that the Yans should compensate more than 710,000 yuan. Neither party was satisfied with the verdict and appealed. On November 14 of the same year, the second trial was held in court.
On March 18 this year, the Fifth Intermediate People's Court of Chongqing made the final ruling: Mr. and Mrs. Yan should compensate Ms. Zhang with over 950,000 yuan. This case is the largest compensation amount in China for an infringement case caused by keeping animals.
Special Reminder:
Tibetan Mastiffs must be carefully supervised during their mating season.
A staff member of a Tibetan Mastiff breeding garden in Beibei District also told reporters that every year from October to January of the following year is the mating season for Tibetan Mastiffs. During this period, the normally fierce and aggressive Tibetan Mastiffs become even more restless, so supervision must be more careful. "The cage where the dog is kept should have an extra iron gate or the chain used to tie the dog should be appropriately thicker to prevent it from breaking free." Tibetan Mastiffs must wear muzzles when going out to prevent accidents.
