In accordance with the spirit of the "Notice of the General Office of the State Council on Strengthening the Construction of Credit Guarantee System for Small and Medium Enterprises" (Guo Ban Fa [2006] No. 90) and the "Notice of the General Office of the State Council on Several Opinions on Promoting Economic Development through Current Financial Work" (Guo Ban Fa [2008] No. 126), in order to better cope with the international financial crisis, support and guide credit guarantee institutions for small and medium enterprises to provide loan guarantees and financing services, especially for small enterprises, and make efforts to alleviate the difficulties of small and medium enterprises in obtaining loans and financing, and help small and medium enterprises get out of difficulties, we now notify relevant issues regarding continuing to do a good job in exempting business tax for credit guarantee institutions for small and medium enterprises as follows:
I. Tax-exempt Conditions for Credit Guarantee Institutions
(1) Approved by government authorized departments (small and medium-sized enterprise management departments), legally registered as enterprise (public institution) legal persons, and mainly engaged in providing guarantee services for small and medium-sized enterprises. The actual received capital exceeds RMB 20 million.
(2) Not primarily profit-oriented, guarantee service charges do not exceed 50% of the concurrent loan interest rate.
(3) Have more than two years of sustainable development experience, funds are mainly used for guarantee business, possess sound internal management systems and the ability to provide guarantees for small and medium-sized enterprises, and have outstanding operating performance.
