News Updates on Overseas Labor Knowledge - How much do you know? How to choose an overseas labor company?
February 23, 2012, 10:25:08
For the general public, working abroad through Taian labor services is filled with temptation and aspiration. However, the path of choosing Taian labor services is not always smooth. The procedures for handling overseas labor formalities, signing labor contracts, and how to best protect one's legal rights are all issues that every overseas laborer must be aware of. Generally, Taian labor services can be divided into several stages, starting with selecting a good labor company.
When signing a contract, it is crucial to ensure the following details are included: work location, occupation type, labor conditions, work hours, rest and holidays, remuneration, transportation, living conditions, responsibilities for violating the labor contract, conditions for changing or terminating the labor contract, protection conditions for female workers and special occupations, dispute resolution, and handling of workplace injury accidents. After going abroad, foreign employers usually pay wages (which should not be lower than the minimum standard set by China's Outward Engineering Contracting Chamber of Commerce) and overtime fees, and generally bear additional costs such as food, accommodation, gas and electricity, commuting, income tax, medical insurance (in some countries like Japan, dental treatment is not covered), personal injury insurance, round-trip airfare, labor protection supplies, and deposits paid to local governments by the employer.
It is important to know which country or region you are going to, the names of the operating company and foreign employer; what kind of work you will be doing, the duration of employment, probation period, number of workdays per month or week, daily working hours; compensation package including basic salary, holiday overtime fees, payment methods, etc. Additionally, you can request the operating company to show copies of the Ministry of Commerce issued "Qualification Certificate for Foreign Economic Cooperation" and the contract signed with the foreign employer.
If you feel satisfied with the treatment and working conditions of the overseas labor project, you can fill out the registration form and other personal information. After registration, the operating company and some foreign employers (such as Japan) may conduct written tests, interviews, and other preliminary selections. After passing the initial selection, the hired personnel usually sign a preliminary agreement with the operating company and pay certain service fees and pre-departure expenses, which are generally borne by themselves. The operating company and foreign employer are responsible for assisting the dispatched labor personnel in handling various departure procedures, including domestic passports, visas, exit permits, training certificates, and foreign entry permits, work permits, etc. Before dispatching abroad, the labor personnel must sign the "Outbound Labor Contract" with the operating company or the "Employment Contract" with the foreign employer. The content of these two contracts must be basically consistent with the "International Labor Cooperation Contract" signed between the operating company and the foreign employer. It is particularly important not to sign the "Outbound Labor Contract" with any agency that does not provide the agency authorization letter from the operating company or copies of the contract signed between the operating company and the foreign employer. Only operating companies approved by the Ministry of Commerce have the authority to sign the "International Labor Cooperation Contract."
