More than 41 months after the case of a Hunan female teacher found dead in the nude, the naked death case of Huang Jing, who was considered as "the first Internet case in China", was finally sentenced yesterday in the court of Yuhu District, Xiangtan City, Hunan Province. The judgment book was 20 pages long, but the result was only a few lines: First, defendant Jiang Junwu is not guilty; Second, defendant should pay plaintiffs Huang Shuhua and Huang Guohua economic losses of 59399.5 yuan; Third, other claims from the plaintiff are rejected.
Jiang Junwu walked alone across the railing without the police who were guarding him.
During the reading of the verdict, Huang Shuhua remained expressionless. After it ended, she lifted the portrait of Huang Jing and walked a few steps to the front of the bench, loudly questioning the judge. Neither the presiding judge nor the associate judges paid attention to her. She turned around again, and her sharp voice rang out in front of Jiang Junwu, who was signing at the defendant's seat: "Can you look yourself in the mirror?!" "I said I can," seven hours later, Jiang Junwu recalled this scene while sitting on the sofa at home, "I asked her back whether this is worthy of Huang Jing."
The court ruled that special sexual behavior does not constitute rape
The court used one and a half pages to state the facts recognized, temporarily concluding this influential case. The court recognized that: Jiang Junwu and Huang Jing were in a romantic relationship. On the morning of February 24, 2003, when Jiang stayed overnight at Huang's dormitory and proposed having sex with Huang, Huang expressed her wish to wait until marriage. Jiang respected his lover Huang's wishes and engaged in sexual activity in a relatively special way. Subjectively, he did not have the intention to commit rape, objectively, there was no act of forcibly having sex against the will of women, thus not meeting the elements of the crime of rape.
Next, the verdict criticized the prosecution: The public prosecution agency failed to comprehensively recognize all evidence in the case, and mistakenly identified one of his actions, namely defendant Jiang Junwu's action of bending Huang Jing's legs behind her knees, as a violent act of rape, which is an error in fact and understanding.
The verdict also explained the cause of Huang Jing's death: On the basis of potential pathological changes, the sexual activity conducted by Jiang Junwu in a relatively special way triggered her death... There would be no death if there was only this behavior and no underlying pathological change in Huang. It can be seen that Jiang's actions and Huang's underlying pathology were the common causes of death. Jiang should bear 50% of the civil liability for the consequences of Huang's death.
Subsequently, the verdict used half a page to determine the amount of civil compensation, with economic losses exceeding 110,000 yuan, and Jiang Junwu should compensate...
